RE: MAR Notice No. 2026-406.2(Notice of Adoption)
Dear Interested Party,
The Montana Department of Environmental Quality(department) has adopted changes to
Administrative Rules of Montana (ARM)to implement House Bill 685, 2025 Mont. Laws ch. 712,which
was enacted by the 2025 Regular Session of the Montana Legislature to address feasibility allowances
and Montana's nondegradation policy.This rulemaking action includes amendments to four rules:ARM
17.30.201,ARM 17.30.706,ARM 17.30.707, and ARM 17.30.708.
This adoption comes after considering all the comments submitted during the public hearing and public
comment period.The department wishes to thank all those who participated and provided input on this
rulemaking.
The notice of adoption was published on August 7, 2026, in the 2026 Montana Administrative Register,
Issue 15.The notice of adoption is available on the Montana Secretary of State's website at
https://rules.mt.govL or on the department's website at https://deg.mt.gov/about/lawsandregs.
