All deviations from standards set forth in The Design and Construction Standards and COB Modifications to MPWSS must be approved by the COB Engineering Division. The request for a deviation must be submitted in writing to the City Review Engineer using the Engineering Standards Administrative Waiver Request form posted on the City website. An Administrative Waiver Request be submitted through the City’s electronic plan review system with the Preliminary Infrastructure Review submittal (Stage 2, Planning Division) or Final Infrastructure Review (Stage 3, Engineering Division). If a waiver request is approved during Stage 2, the Applicant shall include the approval with the Stage 3 submittal. Response: It is requested for this project that the City of Bozeman waive the requirement to limit the length of the connection to water services. Per BMC 38.410.070.B, the length of water services lines from the main to the structure may not exceed 150 feet in length unless approved in writing by the city. Both the proposed domestic and fire service lines are proposed to be longer than the 150’ limit which requires a written deviation request. Section 1.9.2. – Administrative Waiver Review Criteria. Adequate justification for the waiver request must be provided. Cost of meeting the Standards generally is not a valid justification for an Administrative Waiver request. The following criteria will be used to evaluate a waiver request: A. The deviation from standards is not in conflict with applicable state and federal codes and requirements. Response: The deviation being requested is for the connection of water service lines on the site which are greater than 150’ in length. No state or federal codes would preclude the installation of water services of this length. B. The deviation from standards will not harm, or will be beneficial to, the public in general. Response: The requested deviation would not impact the pubic or anything offsite. C. The deviation from standards is consistent with the general purpose of standards to protect public health and safety and promote operational efficiency while minimizing life-cycle costs of public infrastructure. Response: The deviation is intended to allow the site to be served by water. The proximity of the building’s connection point to the source of water service cannot be reduced due to the prototype layout of the building’s floor plan. No substantial impacts to operational efficiency or life-cycle costs of public infrastructure would occur due to this deviation. Administrative Waiver approval applies only to the project seeking the waiver and does not apply to future phases of the project or other projects. Response: It is understood that the waiver being requested is only acceptable for the approved deviation and no other phases and/or deviations. COB does not have the authority to grant a waiver from the requirements of applicable DEQ standards or waivers from requirements of other jurisdictions. Response: It is understood that the City does not have any authority over deviations within other agency jurisdictions. No waiver of DEQ standards is requested.
