Stiff Professional Building 20 East Olive Street planning@bozeman.net (406)-582-2260 Subject: Discount Tire – Bozeman, MT Parcel North of 5997 E Center Valley Road, Bozeman, MT 59718 Conceptual Review Application Departure Narrative Description Due to existing site conditions created by previously established city projects, the development of this site will require a formal filing for a departure from the required code. Per The City of Bozeman Landscape and Irrigation Performance and Design Standards Manual" - Section 1.4 - "Previously Established City Project Specific Conflicting Condition" and Section 3.3.5 - "Collector, Arterial, and Local Street Boulevards", the boulevard area of the proposed development has several conflicts with what is required per code. The first conflict and request for departure would be for the requirement of needing to provide overhead irrigation for landscaping in the areas less than 8’ in width between the proposed meandering pedestrian pathway and E Valley Center Rd. The situation is created by the pre-determined alignment of the pathway which reduces distances at locations where the path comes close in proximity to E Valley Center Rd. Another conflict which there is a request for departure would be to match the landscape of the neighbors. The frontage road, E Valley Center Rd, is in an MDT governed right of way. Per city recommendation from prior experiences, it is suggested that all trees and shrubs be located on the east side of the proposed pathway, and not along E Valley Center Rd, as it is maintained by MDT and they have previously removed all trees west of the pathway. If approved, this departure would promote uniformity of the landscaping along the corridor. The last conflict which requires a requested departure is for the proposed allowable lawn area of 20%. The area to the right of the proposed meandering pathway is an area not intended to be developed and with the predetermined layout for the area, the lawn coverage of the area will reach a coverage of about 33%. It was suggested by the Water Conservation Division that if the proposed area exceeds the minimum 20%, a departure is to be filed to exempt the area from the landscape area coverage for the site and the area could be made to match the adjacent property’s shared pathway and lawn.
