Re: BCPC Facility – Offsite Wetland Delineation Explanation
Reviewers,
This letter is to certify that no wetlands exist on the BCPC Facility parcel, Lot 12, Block 2 of the Gallatin
Park Subdivision. Power Engineers conducted a wetland investigation in early September of 2025 and
found no wetlands on the site. In review of wetlands within 50’ of the site, wetlands were discovered to
the north of the site on the Owners Association parcel. These wetlands were delineated and a 50’
setback was established on the site. The 50’ setback was established to void the need to obtain a
jurisdictional determination for the offsite wetlands.
In order to obtain a jurisdictional determination, significant work would need to be completed on
adjacent private property parcels.
On November 14th, 2025, a discussion was had with Shane McClaflin, property manager for East Gallatin,
LLC, which is the property owner to the north of the Owners Association property. The manager did not
see how a delineation on their property was necessary since no wetlands were being filled and the
proposed work was over 150’ away. Therefore, we were unable to access the site to provide enough
information for a jurisdictional determination from the Army Corps.
In discussions with Nick Ross, the director of Transportation and Engineering, he said that our effort
described above met the intentions of the Wetland Regulations, especially with the conservative 50’
setback and lack of wetland impacts proposed.
