SEWER AND WATER PIPELINE AND ACCESS EASEMENT AND AGREEMENT
Gallatin County,the GRANTOR(S),in considerationof One Dollar($1.00)and othergood and
valuableconsideration,receiptof which isacknowledged,grant(s)to The City of Bozeman,a
municipal corporationof the Stateof Montana,with officesat 121 North Rouse Avenue,
Bozeman,Montana 59715,ÓRANTEE,itssuccessorsand assigns,a perpetualeasement to lay,
constructand maintain sewer and water pipelineswith the usualservices,valves,connections,
accessoriesand appurtenancesforthe purpose of transmittingsewage and water in,through,and
acrossa stripof land situatedinGallatinCounty,Montana,of varying width to be locatedon
the following describedrealproperty:
Portions of Lot 1,2,3,and 4 of Hidden Creek Minor Subbdivision No.ssa ,
and further locatedwithin Portions of the SW ¼of Section 1,T2S,R5E,PMM,City
of Bozeman,Gallatin County,Montana
The easement ismore particularlydescribedon the attachedExhibit A and Exhibit B
which by thisreferenceare made a parthereof.

This grantincludesthe rightof the GRANTEE,itssuccessors,permittees,licensees,and
assignstheiragentsand employees,to enteratalltimes upon theabove-describedlandby using
existingroads or trailsor otherwiseby a routecausing the leastdamage and inconvenience tothe
GRANTOR(S)in orderto survey and establishtherouteand locationof the easement and the
pipelineand to:
(1)Construct,operate,patrol,repair,substitute,remove,enlarge,replace,and maintain the
pipeline,services,connections,accessoriesand appurtenances;
(2)Trim,remove,destroy,or otherwisecontrolany treesand brush insideor outsidethe
boundaries of the easement which may,inthe opinion of the GRANTEE,interfereor
threatento interferewith or be hazardous tothe construction,operationand maintenance
of the pipeline;
(3)Grade the land subjecttothiseasement and extend thecutsand fillsofthisgrading into
and on the land adjacenttothatwhich issubjecttothiseasement totheextentGRANTEE
may findreasonablynecessary;and
(4)Support thepipelineacrossravinesand water courseswith structureswhich GRANTEE
deems necessary.
THE GRANTEE AGREES:
(1)That,in connectionwith the construction,operating,patrolling,repairing,substituting,
removing,enlarging,replacing,and maintainingof saidSewer and Water pipelines,it
willrepairor replace,atitssoleexpense,or pay to GRANTOR(S)thereasonablevalue of
any damages to growing crops,existingfences,ditchesand otherappurtenancesof said
land thatmay be disturbedby itsoperation.
(2)That,during operationsinvolvingexcavation,itwillremove thetopsoilfrom thetrenched
areato a depth of one foot,or to the fulldepth of thetopsoil,whichever isless,and

stockpilesaidtop soilforreplacement over the trench.Itwillremove from the siteany
largerocks or surplusexcavatingmaterialor any debristhatmay have been exposed by
theexcavationand remains afterbackfillingiscompleted.And,itwillleavethe finished
surfacein substantiallythe same conditionas existedpriortothebeginning of operations
except thatthe surfaceof backfilledareasmay be mounded sufficientlytopreventthe
formation of depressionsafterfinalsettlementhas taken place.
THE GRANTOR(S)AGREES:
(1)At no time willthey build,construct,erector maintain any permanent structurewithinthe
boundaries of saideasement without thepriorwrittenconsent of GRANTEE.
(2)At no time willthey modify the finishedgrade of the land over the pipelineby removal of
existingsoilor by placement of fillmaterialwithinthe boundariesof saideasement
without the priorwrittenconsent of the GRANTEE.
(3)That where the subjectimprovements arenot locatedunder improved publicor private
streetsor otherprovided access,a 12 footwide all-weatheraccessroad may be
constructedwithinthe easement where atthe City'sdiscretionsuch accessisrequiredfor
operationand maintenance purposes.
(4)The GRANTOR(S)warrantsthatthey are lawfullyseizedand possessed of the real
propertydescribedabove,thatthey have a lawfulrighttoconvey theproperty,or any part
of it,and thatthey willforeverdefend the titleto thispropertyagainsttheclaims ofall
persons.
(5)The GRANTEE may peaceably hold and enjoy the rightsand privilegeshereingranted
without any interruptionby the GRANTOR(S).The terms,covenants and provisionsof
thiseasement and agreement shallextend to and be binding upon the heirs,executors,
administrators,personalrepresentatives,successorsand assignsof the partieshereto.
