Applicant Questions for Engineering: b) Agricultural Water User Noticing
Ditch Noticing Checklist: BMC 38.310.010 - The applicant must fill out the Ditch Noticing Checklist found on the planning website and provide the relevant documentation with the subsequent
site plan application. As of June 18, 2025, the checklist is required with all concept reviews, site plans, master site plans, subdivision pre-applications, subdivision preliminary
plats, and PDZs.
The creek abutting the subject property, Cattail Creek, is used as a ditch and has been identified as a section of ditch belonging to the Farmers Canal Company as depicted on the City
GIS map viewer digitized record of the historical water resources survey of Gallatin County completed by the office of the State Engineer in 1953. The ditch notice process was completed
with the subdivision. Box 2A on the ditch noticing checklist addresses this situation.

Engineering Design Reports:
(1) City of Bozeman Design and Construction Standards Chapter 3.2 Design Reports: The applicant must submit water and sewer design reports with the site plan application. Please reference
the requirements in this chapter. The applicant must verify the project is in compliance with the existing Certificate of Subdivision Approval (COSA). Please reference the COSA in the
City documents folder.
(2) City of Bozeman Design and Construction Standards - Storm Drainage Design The applicant must provide a stormwater report with the site plan application. Please reference the stormwater
drainage report and maintenance plan requirements in chapter 6.4 and attachment B.
(3) Please reference the criteria in 38.710.050.A.11.g in the updated UDC for the traffic impact study thresholds. If the applicant meets the TIS threshold per the table, the applicant
should verify the proposed development does not generate more trips than estimated during the subdivision review per BMC 38.710.070.C9.a. The applicant is advised that the intersection
of Nelson Road and the Frontage Road is planned to be signalized. Montana Department of Transportation (MDT) is working with subdivision development on funding share for installation
of the warranted signal at this time.

City of Bozeman Design and Construction Standards Chapter 1.4 - Plans, specifications, and submittals for fire service lines and water service lines 4-inches and larger must be submitted
by the professional engineer to the City Engineering Department through the engineering Project Dox Portal for infrastructure/fire service line review. The site plan application must
reach adequacy according to the review engineer prior to initial infrastructure submittal. The infrastructure/fire service line review must be approved prior to the issuance of a building
permit. Please see the infrastructure review fee schedule on the City Engineering website.

Applicant Questions for Engineering: c) Wetland Delineation
BMC 38.710.070.C.7.h.(2) - Site Plan Submittal Requirements & BMC 38.710.120.A - Submittal Materials for Activities in or Adjacent to Wetlands and Watercourses
With the subsequent site plan submittal, the applicant must show wetlands and watercourses on-site and within 100 feet of the project boundary. Please provide the following information
so the City has complete documentation with the application:
(a) If wetlands information was provided with a prior subdivision, provide delineation of on-site wetlands per the subdivision work on the site plan. The developer must provide recertification
from a wetlands professional per 38.610 that site wetlands mapped with the subdivision are still accurate or provide new delineation.

BMC 38.530.020.L - Snow removal storage areas: Below is a general snow storage comment from the new code.
All parking facilities containing 5 or more parking spaces must provide a snow management plan. The plan must contain the following:
1. Locations for snow storage, which may include on-site landscaped areas, and other open space for at least 15 % of the total area of the site used for parking, access drives, walkways
and other paved surfaces;
2. Snow storage is not allowed:
a. In the public right-of-way;
b. Where it would obstruct line of sight or vision triangle;
c. In a location where it blocks fire hydrants, emergency vehicle access or access to other properties;
d. Where it will cause unmanageable freeze/thaw and icing of sidewalks, pathways and other paved surfaces;
e. Where it obstructs on-site amenities, including but not limited to points of egress, mailboxes, storage areas, and trash enclosures;
f. Within any access easement;
g. Where placed in a manner which violates the Clean Water Act (CWA) and/or the Montana Pollutant Discharge Elimination System (MPDES), and/or any other federal, state or local law or
statute; or
h. Where it will cause damage to trees located in the public right-of-way.

Water Rights and Water Adequacy:
Prior to the site plan application being deemed adequate for review, the applicant must describe how it intends to satisfy water adequacy requirements in BMC 38.410.110 and meet requirements
of BMC 38.710.050.A.19. The information provided should be compiled into a preliminary water adequacy compliance report containing the following:
a) A description of water rights associated with the property or otherwise available to the applicant, and a description of whether each respective water right is appurtenant to the
property or has been severed from the land title.
b) A description of the proposed lots for which a payment of cash in lieu of water rights will be provided and the proposed lots for which deferred compliance of BMC 38.410.130 will
be sought.
c) A description of the proposed lots for which non-potable irrigation systems will be provided; the anticipated irrigation water demand of each lot; and the water source proposed to
supply the non-potable irrigation systems.
i) If exempt wells are proposed for irrigation supply, then the applicant must obtain DNRC approval of Form No. 602I Notice of Intent to Appropriate Groundwater prior to adequacy.
ii) If exempt wells authorized by DNRC under an approved notice of intent to appropriate groundwater are inadequate to meet the anticipated irrigation demands and existing irrigation
water rights are associated with the property or otherwise available to the applicant , then the applicant must:
(1) Evaluate the legal elements of the water rights to determine if a DNRC change authorization is required to use the rights as proposed.
(2) Confirm that the flowrate and volume of the water rights are adequate to meet the anticipated irrigation water demands.
(3) Confirm that existing water conveyance facilities can deliver the water rights from their point of diversion to the proposed place of use. If existing conveyance facilities are inadequate,
then provide a description of improvements needed to deliver the water rights to the proposed place of use.
d) Provide a copy of the following documents as attachments to the report:
i) DNRC-approved notice of intent to appropriate groundwater.
ii) Abstracts of water rights associated with the property or otherwise available to the applicant.
iii) Copies of any share certificates from a canal company, ditch company, or water users association that are held by the applicant.
iv) The annexation agreement for the property.
v) Any existing water adequacy agreements pertinent to the property or development.
Comment
The applicant is advised that the lift station serving the development is privately owned and operated. The City cannot sign an MFE for any lot within the Nelson Meadows Subdivision.
The applicant is advised that lot aggregations which eliminate internal lot lines fall under platting act exemption 76-3-207(1)(f) and do not require an MFE. The applicant is advised
that other types of subdivision exemptions and main extensions may require DEQ subdivision review. The certificate of subdivision approval (COSA) has been uploaded to the City documents
folder for reference.
The applicant is advised that lot 2 and lot 3 shall be used for commercial units and are limited to 960 gallons of wastewater per acre per day at the Nelson Meadows Lift Station per
the subdivision COSA.

There are currently two addresses on these lots. Once these are assigned via Subdivision Exemption, we can revisit and see what adjustments to be made to have one address for one structure
over the two lots.

Applicant Questions for Engineering: Sump Drains
f) Sump drains are not allowed to discharge to a street or other public right-of-way, a sanitary sewer line, or onto neighboring properties. Please review the City Engineering sump drain

Additionally, the applicant is advised the recorded Nelson Meadows final plat (doc. 2704913) has a condition of approval on sheet 3 which states, "The proposed development falls within
a known area of high groundwater as identified in the Groundwater Report. No crawl spaces or basements may be constructed."

Applicant Questions for Engineering: Concurrent Construction
e) Concurrent construction is not required or applicable for the installation of a fire service line and a domestic water service line. Fire service lines and domestic water service
lines 4-inches and larger require review and approval by the Engineering Division through the engineering infrastructure review process, however the services are privately maintained
past the curb stop. The infrastructure/fire service line review must be approved prior to the issuance of a building permit.

Applicant Questions for Engineering: Snow Storage
a) Paved areas below overhead canopies where it can be reasonably assumed that snow will fall onto the roof instead of the ground don't need to be included in the snow storage calculation.

BMC 38.710.070.C.7.b - Please show the full adjacent street section and street rights-of-way within 150 feet of the project. City staff need to verify the proposed layout will meet the
code requirements and function in relation to the existing accesses and fire hydrants. Accesses should generally line up where possible and meet the minimum spacing requirement of at
least 40 feet on a local street per table 38.400.090-1.

The applicant must install two-way stop control at the intersection of Royal Wolf Way and Prince Lane with the proposed development project. Current City Engineering policy under the
October 2024 updated engineering design standards no longer supports uncontrolled local street intersections. Please add this to the site plan submittal.

On June 15th, 2024, Ordinance 2155 and Resolution 5586 were adopted by the Bozeman City Commission as well as the associated City of Bozeman Landscape and Irrigation Performance and
Design Standards Manual. Projects not deemed "adequate” by June 15, 2024 are now subject to these new code requirements. To familiarize yourself with these requirements please visit

The Nelson Meadows Subdivision record drawings and the COSA exhibit shows a 20-foot utility easement for a gas main in the general location of the proposed building on lot 2, block 5.
It's unclear whether the gas main was relocated and if the easement was released. Please provide clarification with the site plan submittal.

Significant Industrial User (SIU) Permit:
Environmental Protection Agency regulations for the National Pretreatment Program require that the City of Bozeman establish a pretreatment program as a condition of its National Pollutant
Discharge Elimination System Permit. As such, the City of Bozeman has established its pretreatment program as included in Chapter 40 Article 3 of the City of Bozemans Municipal Code.
In order to control pollutant discharges and protect the Publicly Owned Treatment Works (POTW) the general pretreatment regulations which apply to all industrial and commercial customers
prohibits the discharge of pollutants.
Lattice Materials previously held a Significant Industrial User (SIU) Permit related to its discharge to the sewer system from the facility on East Tamarack Street. In 2017, the permit
was deemed no longer necessary based on the operations at the East Tamarack facility and it was recommended that Lattice Materials continue to maintain sand traps to ensure proper function.
The City's Pretreatment Coordinator, Chuck Raymond, has provided the pretreatment letter questionnaire and the Bozeman industrial user survey, if applicable, to fill out. The City needs
a better understanding on what changes might occur at the new facility and whether a Significant Industrial User permit will be warranted for this project. Please keep in mind that
this project is limited to 960 gallons of wastewater per acre per day at the Nelson Meadows Lift Station per the subdivision COSA. I have uploaded the information to the city documents

BMC 38.530.070: Number of bicycle parking spaces required. For industrial uses, bicycle parking is required at a rate of one space per 7,500 square feet of gross floor area, with fractional
spaces requiring rounding up to the nearest whole number. Of the total required spaces, 25% must be configured for short-term use, while the remaining 75% must be configured for long-term
use. The code specifies the standards for both short-term and long-term bicycle parking. At the time of formal site plan submittal, the project must demonstrate compliance with the
required quantity and configuration of bicycle parking spaces.

As you are aware the City of Bozeman has adopted new zoning regulations, commonly referred to as the Unified Development Code or UDC. The UDC was formally adopted by the City Commission
on December 16, 2025, with an effective date beginning February 1, 2026. Planning staff comments outlined in this Concept Review application are based on the adopted draft UDC (December

BMC 38.230.030. M-1 (Light Manufacturing) Zoning Standards. For interpretation of the M-1 zoning standards, Prince Lane will most likely serve as the primary street frontage for this
proposed project based on the criteria in BMC 38.260.010.B.2, unless the applicant would like to propose differently in the formal submittal. The following comments are related to M-1
zoning requirements.

BMC 38.230.030.A.4 – Lot Standards, Streetscape. M-1 zoning requires one street tree be planted in the boulevard strip on average every 35-feet. With the formal submittal provide a landscaping
plan that meets this standard.

BMC 38.230.030.B.5 – Building Standards, Windows. M-1 zoning requires 30% window transparency for all street-facing building facades. With formal application the project will need to
demonstrate 30% window transparency along Prince Lane and Royal Wolf Way.

BMC 38.230.030.B.6 - Building Standards, Entrances. M-1 zoning requires a street-facing building entrance every 200-feet per building. BMC 38.260.150 contains standards for entrance
design.

BMC 38.410.010 – General Standards – Natural environment. The new UDC requires the design and development of all land uses must be properly related to topography, and must, to the maximum
extent possible consistent with the other requirements of this chapter, preserve the natural terrain, natural drainage, existing topsoil, trees and other existing vegetation. With formal
submittal the applicant is required to provide a response to this review criteria in the submitted narrative.

BMC 38.510.040 Non-motorized circulation and design. The proposed site layout is meeting this section requiring all buildings to feature a connection to a sidewalk. Provide or document
the following additional circulation requirements with formal submittal:
Per paragraph C.3 - Crosswalks are required when a walkway crosses an on-site paved area accessible to vehicles. Crosswalks must contain contrasting material (such as concrete) and/or
patterns (such as stamped asphalt), excluding painted surfaces. Provide compliant crosswalks in the drawings and civil details where crosswalks are proposed.
Per paragraph C.4 Pedestrian paths through parking lots. Developments must provide specially marked or paved sidewalks through parking areas. At least one walkway must be provided every
four rows of parking or at a maximum spacing of 200 feet. The pathways must provide a safe connection to the building entrance and meet the pathway design standards set forth in subsection
D.
Per paragraph D.2 Pathway design requires 5-foot sidewalks except where the sidewalk is adjacent to perpendicular parking, and an extra 2-feet of walkway is required for vehicle overhang.
7-foot internal sidewalks are required where adjacent to parking spaces.
Per paragraph D.3 Pathways must be separated from structures by at least 3-feet of landscaping.

BMC 38.510.060 – Location and design of service areas and mechanical equipment. With the formal submittal provide the location proposed screening method of all rooftop and ground mounted
mechanical equipment, utility meters, and solid waste enclosures. Provide details for the proposed screening panels for the utility yards. As well as how they will interact with the
height of proposed equipment like generators.
Per paragraph B.3 - Service areas must not be visible from the sidewalk and adjacent properties. Where the review authority finds that the only option for locating a service area is
an area visible from a public right-of-way, internal pathway or pedestrian area, or from an adjacent property, the area may be required to be screened with structural and landscaping
screening measures provided in subsection C and 38.540. Per paragraph C – When ground related service areas, including solid waste collection, are visible from adjacent properties they
must be screened, that screening must be durable and covered. It is unclear if the proposed dumpster location will be visible from the north and east. With formal submittal provide
details for either a solid waste enclosure or adequate screening of the waste pick up location.

BMC 38.520.040 Building Design, Nonresidential Faade Articulation. This section requires the formal application to employ the required design features for non-residential buildings listed
in this code section. Given the industrial nature of the proposed buildings per BMC 38.520.020.D the review authority may waive or relax these provisions in the industrial zones depending
on the type of use, number of anticipated employees and customers, and the site's physical context. The greater number of employees and/or customers and higher visibility levels warrant
a greater application of building design standards. This section requires changes in roofline every 60-feet and vertical building modulation or a change in building materials, siding
style, or color at the same intervals in addition to the additional features. This section also states that only one articulation feature is required on building facades in the M-1
district. This is required for all 4 sides of the building. Staff may support some relaxation to these design standards given the sites location and proposed uses. Provide with formal
submittal in the narrative and drawings an explanation of proposed articulation intended to meet this section.
BMC 38.520.060.C.2 contains requirements for metal siding that must be met with formal submittal.

Minimum parking requirements can be found in BMC 38.530.040. The cover sheet correctly lists 157 spaces required, but then also states 69 spaces are required. With the formal submittal
provide a minimum and maximum parking calculation for motor vehicle parking based on gross floor area, and minimum required bicycle parking. Bicycle parking minimums, required locations,
and rack types can be found in BMC 38.530.070. The first 1,500 gross square feet of a non-residential floor area is not included in the calculation of minimum required parking. It is
included in the calculation of maximum parking.
Comment
BMC 38.530.080 contains off-street loading berth requirements if provided. All loading berths must be at least 12 feet in width and 14 feet in height, exclusive of aisle and maneuvering
space. The new code does not require loading berths, but when required must meet the standards in this section.

Mandatory landscaping and irrigation requirements can be found in BMC 38.540.050. These include parking lot landscaping and screening and street frontage landscaping. Provide a compliant
landscaping plan that meets the City’s water conservation standards design manual and this section.

Site lighting standards can be found in BMC 38.560.040 including standards for parking lot lighting and building mounted lighting, shielding for dark skies, and maximum illumination
in footcandles allowed at property lines. A photometric plan and details for any proposed lighting are required with formal submittal.

B. Is the proposed location and method of screening for solid waste containers acceptable? If not, what additional screening measures are required?
See planning comment #34. It does not appear that the proposed location provides screening from adjacent properties as required in that code section.
C. The updated UDC has revised the requirements for loading berths and there no longer appears to be a quantity or a length requirement. The proposed project will have a loading dock
area and other back house loading areas as shown on the site plan. Does this satisfy the loading berth requirement(s)?

D. Landscape Screening We are anticipating providing screening of parking at key areas, including the site entry drive and trail easement. Does the city have a specific requirement for
screening along the trail, entrances, adjacent stormwater pond, or adjacent sanitary sewer pump station?
See BMC 38.540.050. Parking lot landscape screening is required from the public street and any residential adjacency, it is not required from open space parcels or trails.

We have made attempt to begin early coordination on CILWR prior to site plan submittal but have not received a response from the city so we plan to continue that coordination effort
throughout the site plan review and submit that report showing the anticipated domestic water use calculations for potable, industrial, and irrigation. There are currently plan to utilize
non-potable water source at this site.

We will show the address as TBD for now until an address is assigned.
In prior conversations the applicant team has had with the city, it seemed that the city was ameanable to discussing solutions to sump drainage. Currently, further grounwater studies
are underway to estimate the grounwater flow expected and we will be developing proposed solutions for disposing of this water.

Bicycle parking has been shown on the landscaping plan with calculations on the cover sheet.

30% window transparency is provided on the primary street frontage. With the secure nature of the buidling and the M-1 zoning that 30% is not met on royal wolf way facing the UPS distribution
center on the west.
Total lenth of Primary street frontage (Prince Lane) is 350'-6". There are 3 street facing entrances (1 primary and 2 secondary) on this façade. The lenth of the secondary street (Royal
Wolf way) is 176'-6" with a single entrance/ egress door.

There are two Utility yards on the north side of the buidling. Ground mounted equipment is in these areas that includes cooling towers, gas cylinders, transformers, and backup generators.
Each yard will be screened with a corrugated screenwall blocking views from the west on Royal Wolf way and the adjacent properties to the north and east. Details to be provided. All
walls will match top most height of concealed equipment. 16' tall for cooling towers and 10' tall for generators. No rooftop mechanical equipment is proposed. All equipment will be
housed internal to the buidling. A refuse enclosure / screening will be provided around the bins on the north side of the loading dock drive.
