forthe use ofthe publicin,throughand acrossa ten(10)feetwide stripof landsituatedin
GallatinCounty,Montana,which islocatedon thefollowingdescribedproperty:

The easement ismore particularlydescribedon theattachedExhibitA which by this
referencearemade a parthereof.
The GRANTOR(S)agrees:
(1)To allow theCity to constructthemulti-usepathand make any and allinspectionsof the
multi-usepathand landappurtenanttheretoasthe City reasonablydeems necessary.
(2)To maintainthemulti-usepathattheirown expense inaccordancewith relevantCity
Ordinances,including,butnotlimitedto,snow removal and allmajor and minor repair
work.

The GRANTOR(S)warrantthattheyare lawfullyseizedand possessedof thereal
propertydescribedabove,thattheyhave a lawfulrighttoconvey theproperty,or any partof it,
and thattheywillforeverdefendthetitleto thispropertyagainsttheclaimsofallpersons.
The GRANTOR furtheragreesthattheGRANTEE may peaceablyhold and enjoythe
rightsand privilegeshereingrantedwithoutany interruptionby theGRANTORS.The terms,
covenantsand provisionsof thiseasement shallextendtoand be bindingupon the heirs,
executors,administrators,personalrepresentatives,successorsand assignsof thepartieshereto.
