To the Bozeman Study Commission:
Please see the following comments on Section 2.06 of the draft charter (Vacancies; Forfeiture
of Office; Filling of Vacancies):
There is still a conflict in how a vacancy in the role of mayor is filled. Section 2.06(a)
states that the vice mayor will step in for the mayor in the case of a vacancy, andSection 2.06(c) states that the position of mayor will be filled by appointment in the case
of a vacancy.A better approach would be to establish a clear order of succession: the vice mayor steps
in first. If the vice mayor is unable or unwilling to serve, the commission appoints oneof the remaining elected commissioners. Only if no elected official is willing or able to
serve should the commission turn to an outside appointment.
