HomeMy WebLinkAbout26307 STR Public Notice - Web STR Revised 6-17-2026REVISED NOTICE OF A PUBLIC HEARING FOR A TEXT AMENDMENT AND ORDINANCE APPLICATION The City of Bozeman gives notice of a public hearing to consider potential amendments to Section 38.300.020 to add Short Term Rental Type 2 as an accessory use to the RA zoning district, and to clarify applicability of the standards and processes of Section 38.320.060, Paragraph B, Short Term Rentals to address non-conforming locations and permitting for Type 2 Short Term Rentals in the RA district. This notice serves as part of the Public Engagement as described in the Text Amendment Community Engagement Plan approved by the City Commission during their action to initiate the text amendment process on May 12, 2026. The purpose of the public hearing is to consider Application 26307 for amending and implementing the City of Bozeman zoning regulations, pursuant to Chapter 38 - Unified Development Code (UDC) of the Bozeman Municipal Code (BMC). On June 15, 2026, the Bozeman Community Development Board acting in their capacity as the Planning Commission conducted a public hearing on the proposed Text Amendment and Ordinance. The Board considered a text amendment that allowed only existing Type 2 Short Term Rentals to continue operating in the RA district. The Board recommended allowing any Type 2 Short Term Rental, whether existing or new, as an accessory use in the RA zoning district. The recommendation addresses the existing nonconforming Type 2 short-term rentals in the RA zoning district, but it would also expand the area where Type 2 short-term rentals are allowed. Under the previous version of the zoning code, Type 2 short-term rentals were not allowed in the R-S or R-1 zoning districts, but were allowed in the R-2 zoning district. The RA zoning district combines those zoning districts that were previously R-S, R-1, and R-2. A video recording of the Community Development Board’s deliberation and recommendation is found on the City’s website at https://bozeman.granicus.com/player/clip/2753. On Tuesday, July 14, 2026, at 6:00 p.m., in the Commission Room at City Hall, 121 N. Rouse Ave, Bozeman, Montana, the City Commission will conduct a public hearing on the proposed Text Amendment application, including the recommendation of the Community Development Board to allow Type 2 short-term rentals as an accessory use in the RA zoning district. Remote electronic participation may also be available. Instructions for participating remotely will be included on the meeting agenda. The agenda is available in the Events portion of the City’s website at https://www.bozeman.net/home at least 48 hours prior to the meeting. This application is evaluated against the municipal zoning criteria of state law, Section 76-25- 304(2), Mont. Code Ann. Approval or contingent approval may be granted if the City Commission determines substantial compliance with all criteria are met. The Montana Land Use Planning Act emphasizes public involvement during the policy-making stage and creation of regulations more than during development permitting. The amended regulations as established in Ordinance, if adopted, will be the basis for review and approval of development applications and application of review processes. The public may comment orally at the public hearings or in writing at or prior to the public hearings regarding compliance of this application with the required criteria. Comments should identify the specific criteria of concern along with facts in support of the comment. During the notice period the City will continue review for compliance with applicable regulations. At the City Commission’s public hearing the City Commission may act to approve, modify, or reject the proposal or continue the public hearing to another date. The City Commission may revise any of the proposed actions referred in this notice during the public hearing process. Written comments may be directed to: City of Bozeman ATTN: City Clerk, PO Box 1230, Bozeman, MT 59771-1230, or emailed to comments@bozemanmt.gov.
