RESOLUTION 2026-47
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,MONTANA,PROVIDING
FOR THE ANNEXATION OF A CERTAIN CONTIGUOUS TRACT OF LAND,HEREINAFTER DESCRIBED,
TO THE CORPORATE LIMITS OF THE CITY OF BOZEMAN AND THE EXTENSION OF THE
BOUNDARIES OF THE CITY OF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACT,KNOWN
AS THE HANSON LANE ANNEXATION,APPLICATION 25775.
WHEREAS,the Cityof Bozeman receiveda petitionfor annexation from the property
owner,EmilAnderson,requestingthe CityCommission to extend the boundariesof the Cityof
Bozeman so asto includean area of landcontainingapproximately9.979 acres,describedherein;
and
WHEREAS,an annexationstaffreportwas preparedinaccordancewiththe Commission's
goalsand policiesforannexationand was presentedtothe Commission on May 5,2026;and
WHEREAS,a publicmeeting on saidannexation petitionwas dulynoticedand heldon
May 5,2026;and
WHEREAS,the Cityreceivedno writtenprotestfrom realpropertyowners ofthe areato
be annexed;and
WHEREAS,on June 2,2026,the Commission received the executed annexation
agreement addressingallrecommended terms ofannexation;and
WHEREAS,theprovisionofavailableservices,including,but not limitedto,streets,rights-
of-way,easements,water rightsor cash-in-lieu,and water and sewer hookup fees,to said
contiguoustractas describedisthe subjectof a writtenagreement between the Cityand the
Landowner;and
WHEREAS,the Bozeman City Commission hereby findsthat the annexation of this
contiguoustractisinthe bestinterestsofthe CityofBozeman and theinhabitants/ownersthereof.

NOW,THEREFORE,BE ITRESOLVED by the CityCommission of the Cityof Bozeman,
Montana,to wit:

That itishereby declaredthat,pursuanttoTitle7,Chapter 2,Part46,Mont.Codes Ann.,
the following-describedproperty,which iscontiguousto the municipalboundariesofthe Cityof
Bozeman,be annexed totheCityofBozeman and thatthe boundariesofsaidCityshallbe extended
so asto embrace and includesuch approximately9.979 acres,towit:
A TRACT OF LAND IN THE E½SE¼OF SECTION 3,AND THE W½W½SW¼OF SECTION 2,
TOWNSHIP 2 SOUTH,RANGE 5 EAST,M.P.M.,GALLATIN COUNTY,MONTANA,AND
DESCRIBED AS FOLLOWS:
BEGINNING AT THE SECTION CORNER COMMON TO SECTION 2,3,10,AND 11THENCE
NORTH 01°36'27"EAST ALONG THE EAST LINEOF SECTION 3,A DISTANCE OF 594.83
FEET;THENCE NORTH 89°38'43"WEST,ALONG THE NORTH LINEOF THE PROPERTY
DESCRIBED IN 10 FILM 134 OF DEED RECORDS,FILEDWITH THE COUNTY CLERK AND
RECORDER,GALLATIN COUNTY,MONTANA,A DISTANCE OF 286.86 FEET;THENCE
NORTH 01°26'21"WEST,A DISTANCE OF 731.02 FEET;THENCE SOUTH 89°23'54"
EAST,A DISTANCE OF 325.72 FEET TO THE SECTION LINE COMMON TO SECTIONS 2
AND 3;THENCE NORTH 89°44'00"EAST A DISTANCE OF 165.00 FEET;THENCE SOUTH
1°36'27"WEST PARALLEL TO THE WEST LINE OF SECTION 2,A DISTANCE OF 1,324.38
FEET TO THE SOUTH LINE OF SAID SECTION 2;THENCE SOUTH 89°46'00"WEST ALONG
