See the applicable zoning standards in the Bozeman Municipal Code for tree spacing standards. 2.City standard sidewalks (including a concrete sidewalk section through all private drive approaches) shall be constructed on all public and private street frontages prior to occupancy of any structure on individual lots. Upon the 1 year anniversary (second with concurrent construction) of the plat recordation of any phase of the subdivision, any lot owner who has not constructed the required sidewalk shall, without further notice, construct within 30 days, the sidewalk for their lot(s), regardless of whether other improvements have been made upon the lot. 3.Ownership of all common open space areas and responsibility of maintenance thereof and for city assessments levied on the common open space lands shall be that of the property owners' association. Maintenance responsibility must include, in addition to the common open space all vegetative ground cover, snow removal, boulevard trees and irrigation systems in the public right-of-way boulevard strips along all external perimeter development streets and as adjacent to public parks or other common open space areas. All areas within the subdivision that are designated herein as common open space, including pathways, are for the use and enjoyment by the residents of the development and the general public. The property owners' association is responsible for levying annual assessments to provide for the maintenance, repair, and upkeep of all common open space areas and trails. At the same time of recording the final plat the subdivider shall transfer ownership of all common open space areas to the property owners' association created by the subdivider to maintain all common open space areas within the Subdivision. 4.This is a known area of high groundwater. No crawl spaces or basements will be permitted with future development of the site unless a professional engineer registered in the State of Montana certifies that the lowest point of any proposed structure is located above the seasonal high groundwater level and provides supporting groundwater data prior to release of building permit. In addition, sump pumps are not allowed to be connected to the sanitary sewer system. Sump pumps are not allowed to be connected to the drainage system unless capacity is designed into the drainage system to accept the pumped water. Water from sump pumps may not be discharged into streets, such as into the curb and gutter where they create a safety hazard for pedestrians and vehicles. 5.The property owners' association is responsible for maintenance of any lighting located outside of public street rights-of-ways. 6.The property owners' association is responsible for maintenance of all stormwater infrastructure located outside public street rights-of-way. 7.Pursuant to BMC Sec. 38.410.110. The City’s water adequacy requirement had been deferred to future site development for the following lots: Block 1, Lot 1; Block 2 Lot 1 & 2; Restricted Lot 1. No cash-in-lieu of water rights have been paid for these lots. Prior to future development approval, the City’s water adequacy requirements must be met. 8.Block 1, Lot 1 has been platted as a commercial lot and is exempt from park and recreation requirements per BMC Section 38.420.B.2. - parcels that are created which are non-residential. Development of Block 1, Lot 1 must be consistent with non-residential use. Upon subsequent development, if the lot is no longer exempt from the park dedication requirement the development is subject to BMC Section 38.420.020.A. CERTIFICATE OF COMPLETION OF WATER-RELATED IMPROVEMENTS I, _____________________, hereby certify that the following improvements, necessary to meet the requirements of Chapter 38 of the Bozeman Municipal Code or as a condition(s) of approval of The Final Plat of SRX - II SUBDIVISION have been installed in conformance with the approved plans and specifications, or financially guaranteed and covered by the improvements agreement accompanying this plat.
