HomeMy WebLinkAboutResolutions 2026-40 - APPROVING ALTERATION OR MODIFICATION OF CONTRACT WITH HASELDEN MONTANA CONSTRUCTORS RESOLUTION 2026-40 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, APPROVING ALTERATION OR MODIFICATION OF CONTRACT WITH HASELDEN MONTANA CONSTRUCTORS WHEREAS, the City Commission did, on the 7th day of October 7, 2025 authorize award of the bid for the I-Ho Pomeroy Peace Park Project to Haselden Montana Constructors; and WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or modifications of the specifications and/or plans of the contract be made by resolution; and WHEREAS, it has become necessary in the prosecution of the work to make alterations or modifications to the specifications and/or plans of the contract. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, to wit: that the proposed modifications and/or alterations to the contract between the City of Bozeman, a municipal corporation, and Haselden Montana Constructors, as contained in Prime Change Order No. 1, attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such signature. The numbers below include all cost mark-ups so it is comparable back to the bid sheet. • The $3,349 on Bid Sheet Line 123 includes new paver material cost and trucking only. Labor for install was included in Bid Line Item 124 ($9,784.32); 208 SF of pavers were included to be installed at $47.04/SF. This assumed minimal removal and the re-use of majority of the existing sand bed as minimal demo of existing pavers was shown on the original plans. • Change Order - $9,386: o Three sides of the paver area curbs were re-worked and the existing paver area and sand bed could not be protected and needed to be removed & replaced. Change order includes 175 SF of existing paver removal and reinstallation, including new sand bed and cost for 35 SF of additional pavers of new color to blend with existing discontinued color. This breaks down to $53.63/SF as removal of the entire paver area is included on top of the installation cost. I realize I have an error on the original XCO where I stated 483 in lieu of 383 sq ft. Levi, We have reviewed and discussed the paver change order request and feel that additional information is needed in order to finalize it. The original bid form included 208 SF of new pavers. A small quantity of resetting existing pavers was also anticipated to be needed, but a separate bid item was not provided for this since we expected the quantity to be small. The cost to integrate a new paver color into the existing pavers and the fact that it required all of the existing pavers to be reset, is a legitimate additional cost and reasonable change order request. However, as presented, the quantities and unit prices for the new vs. existing pavers are unclear. Please provide a breakdown as follows: • Quantity of new pavers beyond the 208 SF that was bid and unit price for new pavers. If the quantity of new pavers is higher than 208 SF, please explain why (i.e. additional new pavers were needed to blend the color through existing). If the unit price for new pavers is different than the unit price on your bid, please explain why. • Quantity of existing pavers that were reset and unit price for resetting existing pavers. This additional breakdown of the quantities and unit prices will help us make a final recommendation to the City and move towards finalizing the change order. Thank you!
