The City of Bozeman gives notice of public hearings to consider potential amendments to Section
38.530.040, Paragraph C.5 to amend the required parking in the B-3 zoning district after October
1st, 2026, and to clarify applicability of the standards and processes of Section 38.320.060,
Paragraph B, Short Term Rentals to address non-conforming locations and permitting for Type
2A rentals in the RA district.
This notice serves as part of the Public Engagement as described in the Text Amendment
Community Engagement Plan approved by the City Commission during their action to initiate the
text amendment process on May 12, 2026.
The purpose of the public hearing is to consider Application 26307 for amending and
implementing the City of Bozeman zoning regulations, pursuant to Chapter 38 - Unified
Development Code (UDC) of the Bozeman Municipal Code (BMC).
On Monday, June 15, 2026, at 6:00 p.m., in the Commission Room at City Hall, 121 N. Rouse Ave,
Bozeman, Montana, the Bozeman Community Development Board acting in their capacity as
the Planning Commission will conduct a public hearing on the proposed Text Amendment and
Ordinance prior to making a recommendation to the City Commission. Remote electronic
participation may also be available. Instructions for participating remotely will be included on the
meeting agenda. The agenda is available in the Events portion of the City’s website at
https://www.bozeman.net/home at least 48 hours prior to the meeting.
On Tuesday, July 14, 2026, at 6:00 p.m., in the Commission Room at City Hall, 121 N. Rouse Ave,
Bozeman, Montana, the City Commission will conduct a public hearing on the proposed Text
Amendment application. Remote electronic participation may also be available. Instructions for
participating remotely will be included on the meeting agenda. The agenda is available in the
Events portion of the City’s website at https://www.bozeman.net/home at least 48 hours prior
to the meeting.
This application is evaluated against the municipal zoning criteria of state law, Section 76-25-
304(2), Mont. Code Ann. Approval or contingent approval may be granted if the City Commission
determines substantial compliance with all criteria are met. The Montana Land Use Planning Act
emphasizes public involvement during the policy-making stage and creation of regulations more
than during development permitting. The amended regulations as established in Ordinance, if
adopted, will be the basis for review and approval of development applications and application
of review processes.
The public may comment orally at the public hearings or in writing at or prior to the public
hearings regarding compliance of this application with the required criteria. Comments should
identify the specific criteria of concern along with facts in support of the comment. During the
notice period the City will continue review for compliance with applicable regulations.
At the City Commission’s public hearing the City Commission may act to approve, modify, or
reject the proposal or continue the public hearing to another date. The City Commission may
revise any of the proposed actions referred in this notice during the public hearing process.
