The above-referenoed Site Plan (SP), application 25709, has reoeived oonditional approval. The oonditions of
approval and code provisions for this site plan are as fdlaws:

1. The Applicar�t is advised that unmet code provisions or code provisions that are not specifically listed as
conditions of approval does not, in any way, create a waiver or other relaxation of the lawFul requirements
of the Bozeman Muniapal Code(B�/IC)or State law.
2. The Applicam has submitted a Subdivision Exemption application, No.25634,to oorr�bine Paroels 1 and
2 of Block A of F�use's Secorxi Addition to the G1fii of Bozeman to establish a single developrr�errt lot.
Reoordation of this arr�ended plat must be acoanplished prior to final approval of this site plan and prior
to issuanoe of a building permit for this project.
3. SID V�Faiver Sec. 38.100.050&Sec. 38.100.070 General Provisions. Prior to final site plan approval, the
applicant must provide and file with the Cour�ty Clerk and F�Corder's office an executed V�faivers of F�ght
to Protest Creation of Special Improverr�ent Districts (SIDs) on City standard fam for the fdlo�wing:
a. Intersection improvements to Church Avenue and Baboodc Street induding lighting,
signalization/d�annelization, paving, curb✓gutter, sidewalk, and stam drainage.

1. B�/IC 38.600.170.C.4.Afloodplain permit must be obtained prior to final site plan approval.The floodplain
permit application and required rr�aterials shall be provided to the City floodplain administrator
electronically through the PDox electronic plan reviewsystem The developrrient applicar�shall notify the
floodplain adrrinistrator that the floodplain permit application has been submitted to PDox by directly
emailing lanoe.lehigh(cr.�ozemanmt.gov.

2. B�/IC 38.510. Storefra�t Blodc Fra�tage. Prior to issuance of a building permit application, the Applic�nt
must provide a revised building elevation sheet for the S. Church Avenue fa�ade that lists the percer�of
dear transparency windovus and doors.
3. B�/IC38.420.Parldand.Priortofinal siteplanapproval,thefinal Casl�ir�lieu-of-Paridand(GLP)evaluation
must be completed and the fee paid. The GLP value determined at time of site plan adequacy vvas
$2.65/sf.The final GLP payment of$12,696.15 is due prior to final site plan approval.
4. BMC 38.410.130. V�fater Adequacy: The project's estimated annual muniapal demand is 1.96 acre-feet
which must be offset prior to site plan approval. At the Cit�ls current GLWR fee rate of$6,000/AF the
GLWRfee for the project is$11,760. Payrr�ent must be rr�ade prior to the final site plan approval.
Per Section 38.100.080&38.200.110, the proposed project shall be completed as approved and desa�ibed in this
application. Any modifications to the submitted and approved application materials shall invalidate the project's
legitirr�ac,y, unless the Applicar�submits the proposed modifications for review and approval by the Department of
Corr7rx�nity Developrrierrt prior to undertaking said modifications.The only exoeption to this law is repair.
Future Impact Fee,s-Building perrrit applications require payment of transportation, water, sev�er and fire impact
fee,s acoording to the Qty of Bozeman adopted impact fee schedule in plaoe at the time of building perrrit issuance.
In addition, other fees such as the Casf-�ir�lieu of Water F3ghts(GLWj and the Casf�ir�Lieu of Parkland (GLP)
are required prior to final site plan approval and issuanoe of a Certificate of Oocupancy for any building within the
Site.
