The undersigned owner of the real property situatedin the County of Gallatin,State of
Montana,and more particularlydescribedas follows:
BEING LOT R4 OF NORTON EAST RANCH SUBDIVISION PHASE 4 LOCATED IN THE
SE 1 4 OF THE SW 1 4 OF SECTION 9,AND THE W 1 2 OF THE SE 1 4 OF THE SE 1 4
OF SECTION 9 LESS HWRW PT OF COS 1005,TOWNSHIP 2 SOUTH,RANGE 5 EAST,
P.M.M.,CITY OF BOZEMAN,GALLATIN COUNTY,MONTANA
IN CONSIDERATION of receivingfinalplatapproval of the subjectpropertyfrom the City of
Bozeman,along with accompanying rightsand privilegesand forotherand valuableconsideration,the
receiptof which is hereby acknowledged,and in recognitionof the impacts to Fallon Street,El
Dorado Avenue,Reliance Avenue,Pond Lily Drive,Water Lily Drive,Laurel Parkway,Babcock
Street,which will be caused by the development of the above-described property,the owner has
waived and does hereby waive for itself,itssuccessorsand assigns foreverthe rightto protestthe
creation of one or more special districtsor special improvement districtsfor the design and
engineering,construction and maintenance of following improvements:lighting,
signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage facilities,for:
a)Fallon Streetbetween El Dorado Avenue and Cottonwood Road,
b)El Dorado Avenue between Valley Commons Drive and Babcock Street

c)Reliance Avenue between Valley Commons Drive and Babcock Street
d)Pond Lily Drive between Valley Commons Drive and Babcock Street
e)Water Lily Drive between Huffine lane and Babcock Street
f)Laurel Parkway between Huffine Lane and Durston Road
g)Babcock Street between El Dorado Avenue and Cottonwood Road
h)Intersectionat Laurel Parkway and Babcock Street
i)Intersectionat Fallon Streetand Cottonwood Road
j)Intersectionat Fallon Streetand Laurel Parkway
Landowner agrees the City has the sole rightto controlthe design and constructionof such
improvements and may include any of the above components and others necessary to ensure such
improvements comply with all adopted City infrastructureplans and requirements.Further,the
Landowner waives itsrightor to make any writtenprotestagainstthe sizeor area or creationof the
districtbe assessedin response to a duly passed resolutionof intentionto createone or more special
improvement districtswhich would includethe above-describedproperty.
In the event a specialdistrictor specialimprovement districtisnot utilizedforthe completion
of these improvements,the developer agrees to participatein an alternatefinancingmethod for the
completion of saidimprovements on a fairshare,proportionatebasisas determined by the City on the
basisof the square footage of property,taxablevaluationof the property,trafficcontributionfrom the
development or a combination thereof.
This waiver ismade forthebenefitof the propertydescribedhereinshallbe a covenant running
with the land.
The terms,covenants and provisionsof thiswaiver shallextend to,and be binding upon the
successors-in-interestand assignsof the Landowner.
