RESOLUTION 2026-26 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,MONTANA,PROVIDING FOR THE ANNEXATION OF CERTAIN CONTIGUOUS TRACTS OF LAND,HEREINAFTER DESCRIBED, TO THE CORPORATE LIMITS OF THE CITY OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE CITYOF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACTS,KNOWN AS THE LSTREET ANNEXATION,APPLICATION 25360. WHEREAS,the Cityof Bozeman receiveda petitionfor annexation from the property owner,Hal Stanley,requestingthe CityCommission to extend the boundaries of the Cityof Bozeman so as to includean area oflandcontainingapproximately17.92acres,describedherein; and WHEREAS,an annexationstaffreportwas preparedinaccordancewiththeCommission's goalsand policiesforannexationand was presentedto the Commission on December 16,2025; and WHEREAS,a publicmeeting on saidannexationpetitionwas dulynoticedand held on December 16,2025;and WHEREAS,the Cityreceivedno writtenprotestfrom realpropertyowners ofthe areato be annexed;and WHEREAS,on March 10,2026,the Commission receivedthe executed annexation agreement addressingallrecommended terms ofannexation;and WHEREAS,the provisionofavailableservices,including,butnot limitedto,streets,rights- of-way,easements,water rightsor cash-in-lieu,waiversof protestagainstcreationof SID's,and water and sewer hookup fees,to saidcontiguoustractsas describedisthe subjectof a written agreement between the Cityand the Landowner;and WHEREAS,the Bozeman CityCommission hereby findsthat the annexation of this DocusignEnvelopeID:1C67539B-EDA9-436B-A548-197BAECDC558 contiguoustractisinthe bestinterestsofthe Cityof Bozeman and the inhabitants/ownersthereof. NOW,THEREFORE,BE ITRESOLVED by the CityCommission of the Cityof Bozeman, Montana,to wit: Section1 That itishereby declaredthat,pursuanttoTitle7,Chapter 2,Part46,Mont.Codes Ann., the following-describedproperty,which iscontiguousto the municipalboundariesofthe Cityof Bozeman,be annexed tothe CityofBozeman and thatthe boundariesofsaidCityshallbe extended so asto embrace and includesuch approximately17.92acres,towit: LegalDescription PARCEL 1: Allthatportionofthe Southwest Quarter ofthe Northwest Quarter(SW¼NW¼)of Section Five(5),inTownship Two (2)South,Range Six(6)East,Montana PrincipalMeridian,lying Northwest on the centerlineofthe County Road known as "L"Streetand Southwest ofthe rightofway ofthe GallatinValleyRailroadCompany and more particularlydescribedas follows: Beginningatthe Northwest Corner of the Southwest One-quarter of the Northwest One- quarterof saidSectionFive(5),thence North 88°53'44"Easton and alongthe Northlineof the Southwest One-quarter of the Northwest One-quarter (SW¼NW¼)a distanceof457.03 to the Southwesterlyrightof way ofthe GallatinValleyRailroad.Thence South 21°17'24" Easton and alongsaidrightof way,a distanceof414.70 feet,to the centerlineofthe County Road known as "L"Street.
