COMMISSION RESOLUTION NO. 2648
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOZEMAN, MONTANA, EXTENDING THE
BOUNDARIES OF SAID CITY OF BOZEMAN SO AS TO
INCLUDE A TRACT OF LAND CONTIGUOUS TO SAID
CITY AND REFERRED TO AS THE STEPHENS PARCEL,
HEREIN MORE PARTICULARLY DESCRIBED, WITHIN
THE CORPORATE I,nUTS THEREOF.
WHEREAS, Commission Resolution No. 2567 was adopted by the
City Commission on August 12, 1985, declaring it to be the intent
of the City of Bozeman to extend the boundaries of said City so
as to include said contiguous tract within the corporate limits
of the City: and
WHEREAS, said tract contains approximately 2.027 acres and
-- is bounded by West Main Street on the south,
and the Volz-Wa1lin
Annexation on the west: and
WHEREAS, a public hearing on Commission Resolution No. 2567
was duly noticed and held on September 3, 1985: and
WHEREAS, on Sept. ember 9, 1985, the Commission voted to
approve the intent to annex the tract as established in
Commission Resolution No. 2567 subject to the following
condition:
A written agreement be negotiated by the City
and the freeholders of the tract that defines the
provision of services including, but not limited
to, rights of way, easements, water rights or cash
in lieu, waivers of protest against creation of
SID's and water and sewer hookup fees.
WHEREAS, the provision of services to said contiguous
tract is subject to a written agreement between the City and
James Stephens and Mabel L. Stephens, record owners of the tract,
dated March 3, 1986: and
WHEREAS, said contiguous tract is described by Certifi-
cate of Survey No. 1345, as filed and in the office of the Clerk
and Recorder of Gallatin County, Montana:
NOW, THEREFORE, BE IT RESOLVED by the City Commission
of the City of Bozeman, Montana:
Section 1
That it is hereby declared that pursuant to Title 7,

Chapter 2, Part 43, M.C.A., the following property contiguous to
the municipal boundaries of the City of Bozeman be annexed to the
City of Bozeman and that the boundaries of said City shall be
extended so as to embrace and include such property, to wit:
The real property located north of West Main Street and east
of the Volz-Wallin Annexation in the County of Gallatin, State of
Montana, and known as the Stephens Annexation which is more
particularly described as follows:
"A tract of land located in the NWl/4 of the
SEl/4 of Section 11, Township 2 South, Range
5 East, P.M.M. , County of Gallatin, State of
Montana; and more particularly described as
follows:
Beginning at the east quarter corner of said
Section 11;
Thence on and along the midsection line of
Section 11 and approximately the centerline
of West Babcock Street, South 890 17' 07"
West, a distance of 1649.73 feet,
Thence South 000 09' 52" East, a distance of
312.79 feet to the true point of beginning;
Thence South 000 09' 52" East, a distance of
258.00 feet to the northerly right-at-way at
u.S. Highway No. 191;
Thence on and along said northerly
right-of-way South 420 17' 16" West, a
distance of 342.43 feet;
Thence on and along the easterly property
line of Tract VW-3 of COS No. 1227 as filed
with the Gallatin County Clerk and Recorder
North 000 04' 58" West, a distance of 507.60
feet;
Thence North 890 04' 31" East for a distance
of 230.43 feet to the point of beginning.
Said Tract 1 contains 2.027 acres, more or
less according to Certificate of Survey #1345
which is on file and of record in the office
of the Gallatin County Clerk and Recorder,
State of Montana."
Section 2
The effective date of this annexation is thirty (30 ) days
following adoption of this Resolution.
Section 3
The annexation of the Stephens Parcel is subject to the
terms of an agreement dated March 3, 1986, by and between the

City of Bozeman and James Stephens and Mabel L. Stephens
regarding the provision of services.
PASSED AND ADOPTED by the City Commission of the City
of Bozeman, Montana, at a regular and stated session of said City
Commission, held on the 30th day of March
