THIS MATTER CANNOT BE HEARD DUE TO LACK OF PROPER NOTICE
Application 25775 was initiated in 2025, prior to the effective date of the newly
adopted UDC. Applicant requests R-3 zoning. That is the zoning classification
identified in the Public Notices posted and published for this hearing.
Since filing the application, the City’s adopted UDC went into effect on February
1, 2026, and by its terms applies to this Application. The UDC has changed the
zoning allowed in Urban Neighborhood areas. By referring to earlier
classifications, the Application has caused confusion and lack of clarity in its
purpose. The general public should not have to make assumptions as to the
level of zoning Applicant seeks, including whether R-B zoning is different that R-3
zoning and whether than is different from existing use or contiguous uses. This is
not adequate notice and should be clarified before proceeding and notice given
clearly stating the actual zoning applicant seeks.
This is inadequate notice and it cannot be waived. Montana Annotated Code
76-25-304. Proper Notice should be republished and reposted before
proceeding further.
