WHEREAS,the Cityof Bozeman receiveda petitionforannexationfrom KDG Holdings, LLC requestingthe CityCommission to extend the boundariesof the Cityof Bozeman so as to includean areaoflandcontainingapproximately10.156acres,describedherein;and WHEREAS,an annexationstaffreportwas prepared inaccordancewiththe Commission's goalsand policiesforannexationand was presentedto the Commission on April8,2025;and WHEREAS,a publicmeeting on saidannexation petitionwas dulynoticedand held on March 25,2025;and WHEREAS,the Cityreceivedno writtenprotestfrom realpropertyowners ofthe area to be annexed;and WHEREAS,on September 9,2025,the Commission receivedthe executed annexation agreement addressingallrecommended terms ofannexation;and WHEREAS,the provisionofavailableservices,including,but not limitedto,streets,rights- of-way,easements,water rightsor cash-in-lieu,waiversof protestagainstcreationofSID's,and water and sewer hookup fees,to saidcontiguoustractsas describedisthe subjectof a written agreement between the Cityand the Landowner;and WHEREAS,the Bozeman CityCommission hereby findsthat the annexation of this Page 1 of3 2860182 Page 2 of 5 09/16/2025 04:05:28 PM DocusignEnvelopeID:3650251D-BOF7-48B7-92EA-A5DEE012101A contiguoustractisinthe bestinterestsofthe CityofBozeman and the inhabitants/ownersthereof.
