PUBLIC STREET AND UTILITY EASEMENT
EMIL O. ANDERSON, GRANTOR, in consideration of $ 1.00 and for other and valuable
considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal
corporation of the State of Montana, with offices at 121 North Rouse Avenue, Bozeman,
Montana 59715, GRANTEE, its successors and assigns, a perpetual street and utility easement
for the use of the public, in, through, and across land situated in Gallatin County, Montana, to be
located on the following described real property:
S03, T02 S, R05 E, ACRES 9.979, TRACT 4 E2E2SE4 & W2W2SW4 SEC 2 LESS RW
The easement is more particularly described on the attached Exhibit A and Exhibit B which by this reference is made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.

EASEMENT - DESCRIPTION
A public street and utility easement located within Tract 3, Certificate of Survey Film 13 Page 166, located in the southwest
quarter of Section 2 and the southeast quarter of Section 3, Township 2 South, Range 5 East, P.M.M., Gallatin County,
Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder, Gallatin
County, Montana, being more particularly described as follows:
Beginning at the northeast corner of said tract;
thence S1°25'41"W, 1279.75 feet along the easterly line of said tract to the northerly right-of-way line of Durston Road;
thence S89°39'43"W, 165.07 feet along said right-of-way line to a westerly line of said tract;
thence N1°24'20"E, 550.02 feet along a westerly line of said tract;
thence N1°26'47"E, 401.21 feet to the beginning of a non-tangent curve to the left, said curve having a radius of 9.00 feet
