To the relevant review authority: I am writing to request clarification regarding the recently noticed demolition application for the structure located at 321 N 5th Ave. Several aspects of the public notice and applicationmaterials appear to be inconsistent with the City’s historic resource documentation and applicable code provisions. First, the City’s Historic Property Record Card identifies the structure as historic under the City’s classification system. The record further notes that the site was “in good condition” andthat “all original windows appear to be intact.” Given this documentation, it is unclear why the public notice for the demolition application states that the structure is not historic.Clarification of how staff determined that the structure is not historic, or how the notice language was derived, would be appreciated. Second, the City’s code requires that properties be maintained in safe condition and good repair. Publicly available inspection reports from the Montana Department of Public Healthand Human Services indicate that the building was functional and passed multiple life-safety inspections prior to its acquisition by the current owner. If the structure has since deterioratedto the point that demolition is being considered on safety grounds, clarification of the timeline and contributing factors leading to that deterioration would be helpful in understanding thebasis for the application. The application packet also contains a letter from the Deputy Chief of the Fire Departmentdescribing unsafe conditions within the structure. However, the letter does not address how those conditions developed during what appears to be a relatively short period of ownership bythe current applicant. Additionally, records obtained through prior public information requests reference discussions with the Fire Department regarding the potential use of the structure fortraining purposes. In light of those records, clarification would be helpful regarding whether the building was ever considered for, approved for, or used in any form of fire trainingactivity, and if so whether any such activity contributed to the conditions now cited as justification for demolition. If such discussions or activities occurred, it would also be helpfulto understand what safeguards were in place to ensure that advisory input from the Fire Department regarding demolition was independent of any prior operational interest in thestructure. (record reference attached) Broadly, if the current condition of the building is the result of a failure to maintain theproperty as required by code, it raises questions regarding the City’s enforcement of provisions requiring that properties be maintained and secured. Code compliance does nothinge on an applicant’s self-reported efforts to secure a property, but rather on whether the property is in fact maintained in safe condition and good repair. As an extension, the City’s code includes provisions intended to address circumstancescommonly referred to as “demolition by neglect,” including potential reconstruction remedies where historic resources have been allowed to deteriorate. If staff determines that the presentcondition of the structure resulted from a failure to maintain the property in accordance with applicable code provisions, it would be helpful to understand whether the City is prepared toconsider and apply the remedies contemplated in those sections of the code. The Secretary of the Interior’s Professional Qualification Standards are referenced in theCity’s review framework for historic resources. In the recent absence of a qualified Historic Preservation Officer, clarification would be appreciated regarding which staff member orconsultant meets those professional qualification standards and is responsible for advising the City on the historic status and treatment of this property as part of the demolition review. Relatedly, it would be helpful if the application narrative clearly identified which existing trees are proposed to remain and which are proposed for removal, in a manner that isconsistent with the accompanying plan drawings. Further clarification would also be appreciated regarding how the proposed landscaping and tree preservation approach complieswith the applicable NCOD standards and guidelines. In prior review of this applicant’s North Central Master Site Plan, commenters noted inconsistencies between the MSP-level materialsand subsequent individual site plan documents with respect to tree preservation, which created confusion during public review. Given the public interest in this property and the broader policy questions involved, clarification of these issues would help the public better understand the basis for the City’sreview of this demolition application.
