considerations,receiptof which isacknowledged,grantsto The City of Bozeman,a municipal
corporationof the Stateof Montana,with officesat 121 North Rouse Avenue,Bozeman,Montana 59715,
GRANTEE,itssuccessorsand assigns,a temporary constructioneasement forthe use of thepublic,in,
through,and acrossa stripof land situatedin GallatinCounty,Montana,tobe locatedon thefollowing
describedrealproperty:Public Common Open Space Lot of theWest Winds Major SubdivisionPhase
2A &2B,PlatJ-445,situatedinthe northwest 1/4of Section2,Township 2 South,Range 5 East,
PrincipalMeridan,City of Bozeman,Montana.
The easement ismore particularlydescribedon the attachedExhibitA which by thisreferenceis
made a parthereof.
The GRANTOR statesthathe possessestherealpropertydescribedabove and thathe has a
lawfulrightto grantan easement thereon.
The terms,covenants,and provisionsof thiseasement shallextend to and be bindingupon the
heirs,executors,administrators,personalrepresentatives,successors,and assignsof thepartieshereto.
Upon completion of the projectforwhich accessishereby provided,the GRANTEE shallrestore
thepropertyas nearlyas possibleto itsoriginalcondition.The GRANTEE agreesto hold GRANTOR
harmless from any and allliabilitythatmay resultor arisefrom theexerciseoftherightsgrantedhereby.
