RESOLUTION 2026 -06 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,PROVIDING FOR THE ANNEXATION OF CERTAIN CONTIGUOUS TRACTS OF LAND,HEREINAFTER DESCRIBED,TO THE CORPORATE LIMITS OF THE CITY OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE CITY OF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACTS,KNOWN AS 1519 ALDER COURT LANE ANNEXATION,APPLICATION 24428. WHEREAS,the Cityof Bozeman receiveda petitionforannexation from LincolnStreet MGME,LLC requestingthe CityCommission toextend the boundaries ofthe CityofBozeman so as to includean area ofland containingapproximately 0.44 acres,described herein;and WHEREAS,an annexation staffreport was prepared in accordance with the Commission's goals and policiesfor annexation and was presented to the Commission on March 25,2005;and WHEREAS,a publicmeeting on said annexation petitionwas duly noticedand held on March 25,2025;and WHEREAS,the Cityreceivedno writtenprotestfrornrealpropertyowners ofthe area to be annexed;and WHEREAS,on January 13,2026,the Commission receivedthe executed annexation agreement addressing allrecommended terms ofannexation;and WHEREAS,the provisionofavailableservices,including,but not limitedto,streets, rights-of-way,easements,water rightsor cash-in-lieu,waivers of protestagainstcreationof SID's,and water and sewer hookup fees,tosaidcontiguous tractsas described isthe subject ofa writtenagreement between the Cityand the Landowner;and WHEREAS,the Bozeman CityCommission hereby findsthatthe annexation ofthis Page 1 of3 DocusignEnvelopeID:2B44E13E-0ABF-4B3F-9E63-BF4A6BDE2239 contiguous tractisinthe best interestsof the Cityof Bozeman and the inhabitants/owners thereof. NOW,THEREFORE,BE IT RESOLVED by the City Commission of the City of Bozeman,Montana,to wit: Section 1 That itishereby declared that,pursuant to Title7,Chapter 2,Part46,Mont.Codes Ann.,the following-describedproperty,which iscontiguous to the municipal boundaries of the Cityof Bozeman,be annexed tothe CityofBozeman and thatthe boundaries ofsaid City shallbe extended so as to embrace and include such approximately 0.44 acres,towit: Legal Description An area ofland comprised described as follows: A tractofland knows as Lot 25 of Beatty'sAlder Court Subdivision(PlatE-46) Section 13,TO2,RO5E inGallatinCounty,Montana,more particularlydescribed as follows: Beginning atthe northeast corner of Lot 25, Said point being marked by a 5/8"rebarwith yellow plasticcap; Thence along the north boundary of said Lot 25,N 89°06'33"W fora distance of 131.57 feettothe northwest corner; Thence along the west boundary,01°29'40"W fora distance of100.00 feetto the southwest corner, Thence along the south boundary,S 89°06'33"E fora distance of 132.36 feetto the southeast corner, Thence along the east boundary,N 01°02'33"E fora distance of 100.00 feetto the Pointof Beginning. Said tractcontains 0.44 acres more or lessand issubjectto alleasements,rights- of-way and restrictionsofrecord.SUBJECTto alleasements ofrecord or apparent from visualinspectionofthe property.
