forand inconsiderationofOne and No/100 -Dollars,and othervaluableconsideration,inhand
paid,grantstothe GRANTEE,the City of Bozeman,a MunicipalCorporationof the State of
Montana,withofficesat 121 North Rouse Avenue,Bozeman,Montana,59715,itssuccessorsor
assignees,an unrestrictedTemporary ConstructionPermit in,over,under,along,though,and
acrossthefollowingdescribedrealpropertylocatedinGallatinCounty,Montana:

Said temporary constructioneasement islocatedon the west sideof North27thAVenue between
BaxterLane and CattailStreetand isdepictedon ExhibitA attachedheretoand more particularly
describedon saidExhibit
Delineatedas to said tractof land on the exhibitattached heretoand made a parthereof as
ExhibitA ofthisinstrument.Said parcel,containing24,829.2square feet,more or less,ishereby
temporarilyprovidedtotheGRANTEE,forthe purpose ofconstructingand/orimprovinga public
street,highway,walkway,trailand/or electric,telephone or telecommunications,gas,water,
sewer,drainage,or otherutilitytransmissionor distributionfacilitiesas necessaryforthe N.27th
Avenue (Baxterto Cattail)Project.Upon completionof saidprojectforwhich access ishereby
provided,the GRANTEE shallrestorethe propertyas nearlyas possibleto itsoriginalcondition.
The GRANTEE agrees to hold GRANTOR harmless from any and allliabilitythatmay resultor
arisefrom the exerciseofthe rightsgranted hereby.

GRANTOR hereby covenants with GRANTEE that GRANTOR has good titleto the above-
described tractofland and covenants thatGRANTEE shallhave quietand peaceable possession

Permit isineffectfora period beginning the 1stday of constructionon the property,and ending
two (2)years later,atwhich time thispermit shallexpireand be of no forceand effect.
