I sincerely appreciate your detailed and personal response. And I am glad you took the comment regarding your name as a compliment! It was definitely meant as such.
I know this is separate from the comment process, but yesterday I happened to look closely at the homes immediately south of the site in question. Those next three houses are actually
very nice houses. There are some homes in the neighborhood that are in need of repair, and needless to say, all properties can probably be improved according to the owner desires,
but those next three houses are very attractive and show a level of personal investment and respect. In today's Bozeman economy, they are about as close to “affordable" as we can get
in the downtown area. The condominiums of The Depot on Church are well beyond a million dollars. And of course, the “Depot” has probably lowered the value of these three homes to
both owners and buyers. It just seems wrong.

I also thank you for your comments about the site plan application for the Depot on Church mixed use development. Your comments are appreciated and will be addressed in the staff
report to the Director and will be conveyed to the Director when she reviews the application and staff evaluation of the proposal and makes her determination on the project.
Note that this application was deemed complete/adequate prior to February 1, 2026 and, therefore, is being evaluated by the City's 2018 Unified Development Code (UDC) and its Neighborhood
Conservation Overlay District (NCOD) standards and, of course, the 2015Bozeman Guidelines for Historic Preservation & The Neighborhood Conservation Overlay District.
Response to your Comment 1. The maximum building height for buildings in the B-3 District outside of the Downtown Core Area is 70-feet. However, UDC Section 38.350.050.D.2.c (shown
below) allows elevator penthouse/sheds to exceed the building height limit provided that the width does not exceed 50% of the site’s street frontage width. The street frontage for
this site is ~60-feet wide. This issue will be addressed in the staff report evaluation of the proposal.

D. Height limitation exceptions.
1. Non-specific exemptions. No building, or part thereof, or structure must be erected, reconstructed or structurally altered to exceed in height the limit herein designated for
the district in which such building is located, except as is specified in division 38.250 of this chapter.
2. Specific exemptions.
a. Height limitations do not apply to church spires, belfries, cupolas and domes; monuments; chimneys and smokestacks; flag poles; public and private utility facilities; parapet
walls extending no more than four feet above the limiting height of the building except as hereinafter provided: amateur radio antennae; solar energy collectors and equipment used for
the mounting or operation of such collectors; and building mounted horizontal and vertical axis wind energy collectors under 15 feet in height from the building mounting surface, and
equipment used for the mounting or operation of such collectors.
b. Places of public assembly in churches, schools and other permitted public and semi-public buildings may exceed height limitations otherwise established by this chapter, provided
that:
(1) The portion of the building that exceeds the height limit must be limited to 10 percent of the total building footprint; and
(2) That for each one foot by which the height of such building exceeds the maximum height otherwise permitted in the district, its side and rear setbacks must be increased in
width or depth by an additional one foot over the side and rear setbacks required in the district.
c. Elevator and stair penthouses, water tanks, monitors and scenery lofts are exempt from height limitations otherwise established in this chapter, provided that no linear dimension
of any such structure exceed 50 percent of the corresponding street frontage line.
d. Towers and monuments, cooling towers, gas holders or other structures, where the manufacturing process requires a greater height, and grain elevators and silos are exempt from
this chapter, provided that any structure above the height otherwise permitted in the district must occupy no more than 25 percent of the area of the lot and must be at least 25 feet
from every lot line.
e. Height restrictions for wireless facilities are governed by division 38.370 of this chapter.

Your Comment #2: Our Engineering Department is evaluating the multi-modal transportation impacts of the proposal and their findings will be addressed in the staff report.
Your Comment #3: Yes, the proposed building will be evaluated against the UDC NCOD standards as well as the NCOD Guidelines noted above. This evaluation will appear in the staff report
to the Director. Your comments are well taken as is your follow-up comment of March 1st.
