31 - Non-Municipal Utilities
Please see the response below to the items in Section 38.220.060 – Additional Subdivision
Preliminary Plat Supplements in the Bozeman Municipal Code.
Non-municipal utilities. The developer must submit a copy of the preliminary plat to all relevant
utility companies. With the preliminary plat, the developer must provide written documentation
of the following:
a. Affected Utilities. Indicate which affected utilities the subdivision plat has been submitted to
for review and include a copy of responses.
b. The developer must provide a written statement from the utility companies that the proposed
subdivision can be provided with service.
c. Non-municipal utility locations shall be coordinated with locations of municipal utilities.
Non-municipal entities were contacted to verify the feasibility of their services for the
subdivision including gas, electricity, and internet. A copy of the subdivision layout was
provided to Spectrum and Northwestern Energy for verification that their services could be
provided to the lots in the future. At this time, only Spectrum has responded confirming the
feasibility to serve the proposed subdivision. A Will-Serve letter from Spectrum (Charter)
is included in this section.

Hi Keigun,
Got another one for you.
I am working on a preliminary plat for the proposed Gran Cielo I Subdivision Phase 3. The
proposed subdivision is located east of the intersection of Bennett Boulevard and S. 27th
Avenue, Geocodes: 06-0798-23-2-01-35-0000, 06-0798-23-2-01-30-0000, 06-0798-23-2-01-05-
0000, and 06-0798-23-2-01-10-0000. The proposed subdivision is approximately 6.48 acres and
will have 44 residential lots. Please refer to the attached preliminary subdivision layout for
further detail.
As part of the Preliminary Plat, we need written documentation of the following from applicable
utility companies:

• A written statement from the utility company that the proposed subdivision can be
provided with service.
• Non-municipal utility locations shall be coordinated with locations of municipal utilities.
The proposed lots will have a 10’ utility easement across the front of said lots to be used by
non-municipal utilities. We understand further coordination will be needed and look forward to
working with you.

Spectrum Will Serve Letter

Location: Gran Cielo I Subdivision Phase 3, Bozeman MT
Thank you for your interest in receiving Charter service. The purpose of this letter
is to confirm that the Property is within an area that Charter may lawfully serve.
However, it is not a commitment to provide service to the Property. Prior to any
determination as to whether service can or will be provided to the Property,
Charter will conduct a survey of the Property and will need the following
information from you:
- Exact site address and legal description
- Site plans, blueprints, plat maps or any similar data
- The location of any existing utilities or utility easements
- Breaking ground date
- Crossing date
- Joint trench date
- Joint trench contractor
- Expected 1st move-in date
Upon receipt, a Charter representative will be assigned to you to work through
the process. Ultimately, a mutually acceptable service agreement for the
Property will be required and your cooperation in the process is appreciated.
