An existing culvert currently conveys water from the Middle Creek Ditch beneath South 27th Avenue right-of-way for a distance of approximately 360 feet. Water enters the culvert at a head unit located east of the South 27th Avenue right-of-way and emerges on the west side, north of Apex Drive, approximately 100 feet from the northeast property corner of Lot 3. b. Written documentation demonstrating active use of the facilities, for example the delivery of non-potable water supplies for irrigation, conversion to storm water facilities, or other use. If a facility is not being actively used nor intended to be used in the future, include a written plan for discontinuance including all documentation required pursuant to Montana Law. A water rights search was conducted on the DNRC Water Rights Query System in order to identify any known water rights owners associated with the property. Searching for S23, T02 S, R05 E, five Statements of Claim were found claiming place of use by the West Gallatin Canal Company. Please see the DNRC Water Rights Statements of Claim included in this section of the submittal. No other claims were found when searching by the geocode of the subject parcels. Due to the close proximity of the Middle Creek Ditch to the subject property, and that improvements to 27th Avenue will be made within the ditch easement, a notification letter was sent to the Middle Creek Ditch Company as owner of the ditch and Montana State University as a downstream user of the water conveyed by the Middle Creek Ditch. In compliance with BMC Section 38.360.280, water rights owners were notified of the proposed subdivision by mail sent to addresses listed on the document on 10/30/2025. c. Describe any proposed realignment. All realignments must comply with all relevant requirements of Montana Law. Gran Cielo Subdivision Phase 3 Preliminary Plat Application There is no proposed realignment of the Middle Creek Ditch associated with Phase 3 of the Gran Cielo Subdivision. d. Information from the owner(s) of the facility concerning the proposed use or discontinuance of the facility. There are no proposed impacts to the watercourses with the initial phase of improvements. The water rights owners have not provided any comment.
