a. Type, description, ownership, and users of facilities.
An existing culvert currently conveys water from the Middle Creek Ditch beneath South 27th
Avenue right-of-way for a distance of approximately 360 feet. Water enters the culvert at a head
unit located east of the South 27th Avenue right-of-way and emerges on the west side, north of Apex
Drive, approximately 100 feet from the northeast property corner of Lot 3.
b. Written documentation demonstrating active use of the facilities, for example the delivery of
non-potable water supplies for irrigation, conversion to storm water facilities, or other use. If a
facility is not being actively used nor intended to be used in the future, include a written plan for
discontinuance including all documentation required pursuant to Montana Law.
A water rights search was conducted on the DNRC Water Rights Query System in order to
identify any known water rights owners associated with the property. Searching for S23,
T02 S, R05 E, five Statements of Claim were found claiming place of use by the West
Gallatin Canal Company. Please see the DNRC Water Rights Statements of Claim included
in this section of the submittal. No other claims were found when searching by the geocode
of the subject parcels.
Due to the close proximity of the Middle Creek Ditch to the subject property, and that
improvements to 27th Avenue will be made within the ditch easement, a notification letter
was sent to the Middle Creek Ditch Company as owner of the ditch and Montana State
University as a downstream user of the water conveyed by the Middle Creek Ditch.
In compliance with BMC Section 38.360.280, water rights owners were notified of the
proposed subdivision by mail sent to addresses listed on the document on 10/30/2025.
c. Describe any proposed realignment. All realignments must comply with all relevant
requirements of Montana Law.

There is no proposed realignment of the Middle Creek Ditch associated with Phase 3 of the
Gran Cielo Subdivision.
d. Information from the owner(s) of the facility concerning the proposed use or discontinuance of
the facility.
There are no proposed impacts to the watercourses with the initial phase of improvements.
The water rights owners have not provided any comment. The 45-day notice period for
comments terminates on 12/14/25.

Dear Recipient,
On behalf of our client, and as part of the subdivision review process, we are providing this
written notification to inform you of the presence of a watercourse tied to your water right near
or within the proposed Gran Cielo Phase 3 Subdivision boundaries, and to request any comments
you may have regarding the proposed development.
The project site is situated south of Apex Dr, west of South 27th Avenue, north of Bennet Blvd,
and east of South 29th Avenue. The current legal description of the property is Gran Cielo Phase
2, S23, T02 S, R05 E, Block 14, Lots 1-4 and Open Space A, B, and C. The geocodes listed on
the Montana Cadastral website are 06-0798-23-2-01-35-0000, 06-0798-23-2-01-30-0000, 06-
0798-23-2-01-05-0000, 06-0798-23-2-01-10-0000, and 06-0798-23-2-32-21-6500. A single
water course runs south to north through an existing culvert in the South 27th Avenue right of
way adjacent to the property. A search on the DNRC Water Rights Query System was used to
identify any known water rights owners.
The existing culvert currently conveys water from the Middle Creek Ditch beneath South 27th
Avenue right-of-way for a distance of approximately 360 feet. Water enters the culvert at a head
unit located east of the South 27th Avenue right-of-way and emerges on the west side, north of
Apex Drive, approximately 100 feet from the northeast property corner of Lot 3.
As part of the proposed subdivision, improvements to a segment of South 27th Avenue that
crosses over the existing Middle Creek Ditch culvert are required in order to comply with City of
Bozeman development standards. The proposed improvements consist of widening of S. 27th
and installation of sidewalk, curb and gutter, and a center median. Additionally, a water main
must be installed to provide service to the lots located on the east side of the Gran Cielo, Phase 3
subdivision. This installation will require a connection to the existing water main beneath South
27th Avenue, necessitating a crossing below the existing culvert. Based on the known inverts of
the culvert, WWC does not anticipate any conflict with the culvert and adequate separation can
be maintained between the new main and existing culvert. In summary, these improvements will
not modify the existing culvert, affect the flow of water through the structure, or disrupt water
delivery to downstream users.
A layout of the proposed subdivision and associated improvements is attached for your
reference.

widening that extends over an existing underground piped ditch system. The flow and alignment

undisturbed.

the structure, or disrupt water delivery to downstream users.
