RESOLUTION 2026 -05
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,MONTANA,
PROVIDING FOR THE ANNEXATION OF CERTAIN CONTIGUOUS TRACTS OF LAND,
HEREINAFTER DESCRIBED,TO THE CORPORATE LIMITS OF THE CITY OF BOZEMAN AND
THE EXTENSION OF THE BOUNDARIES OF THE CITY OF BOZEMAN SO AS TO INCLUDE
SAID CONTIGUOUS TRACTS,KNOWN AS THE 1727 KENYON DRIVE ANNEXATION,
APPLICATION 25051.
WHEREAS,the Cityof Bozeman received a petitionforannexation from the property
owner,Hal Stanley,requestingthe CityCommission to extend the boundaries ofthe Cityof
Bozeman so as to include an area of land containingapproximately 0.903 acres,described
herein;and
WHEREAS,an annexation staffreport was prepared in accordance with the
Commission's goals and policiesforannexation and was presented to the Commission on
August 12,2025;and
WHEREAS,a publicmeeting on said annexation petitionwas duly noticed and held
on August 12,2025;and
WHEREAS,the Cityreceivedno writtenprotestfrom realpropertyowners ofthe area
to be annexed;and
WHEREAS,on January 13,2026,the Commission receivedthe executed annexation
agreement addressing allrecommended terms ofannexation;and
WHEREAS,the provisionofavailableservices,including,but not limitedto,streets,
rights-of-way,easements,water rightsor cash-in-lieu,waivers of protestagainstcreationof
SID's,and water and sewer hookup fees,tosaidcontiguous tractsas described isthe subject
ofa writtenagreement between the Cityand the Landowner;and
WHEREAS,the Bozeman CityCommission hereby findsthatthe annexation ofthis

contiguous tractisinthe best interestsof the Cityof Bozeman and the inhabitants/owners
thereof.
NOW,THEREFORE,BE IT RESOLVED by the City Commission of the City of
Bozeman,Montana,to wit:
Section 1
That itishereby declared that,pursuant to Title7,Chapter 2,Part 46,Mont.Codes
Ann.,the following-describedproperty,which iscontiguous to the municipal boundaries of
the Cityof Bozeman,be annexed tothe CityofBozeman and thatthe boundaries ofsaid City
shallbe extended so as to embrace and includesuch approximately 0.903 acres,towit:

A portionof Lot C ofAldworth's Rearrangement (PlatJ-287),located inthe east half
ofthe southeast one-quarter ofSection 18,Township 2 South,Range 5 East,P.M.M.
Cityof Bozeman,GallatinCounty,Montana.
More particularlydescribed as follows;
Beginning at an R.W.AllenAluminum Cap (AC)inthe Northwest corner ofTractC of
Aldworth's Rearrangement (PlatJ-287);
thence S 28°40'25"E a distance of 154.74 feetto an R.W.AllenAC;
thence S 03°40'38"W a distance of 219.43 feetto a nailand washer;
thence N 52°35'00"E a distance of 135.14 feetto a 1"Swart Nickel Plated cap;
