Dear City Commissioners, I am writing to voice my support for APPEAL 25769 and stop the proposed commercial development of 25238. Application 25238 violates the binding terms of the Sundance Springs PUD, block frontagestandards, development guidelines and multiple sections of Bozeman Municipal Code. There is no need for a commercial space in this residential neighborhood, especially one that violates existing Planned Unit Developments and Block frontage standards. Increasing traffic,especially in two school zones, is also unnecessary and a concern for parents whose children attend or will attend those schools. I am also concerned that the approval of Application 25238 departs from the framework thatwas established when this subdivision was created, particularly the PUD Master Plan dnd Development Guidelines that govern this property. Those adopted documents- together with BMC 38.440.030 and 38.440.050 were intended toprovide predictability for senidents to prevent exactly the type of shift we are seeing here: an effort to significantly expand building size, increase intensity, and change approved useswithout going through the formal PUD amendment process that such changes requite. I understand the desire to align projects with modern zoning, but when long standing PUD requirements conflict with newer ambitions the appropriate path is a public,transparent amendment- not reinterpretation that treats binding terms as optional. I respectfully request that the City Commission uphold the intent and requirements of the original Sundance Springs PUD, ensure compliance with the Development guidelines andMaster Plan, and reaffirm the importance of consistent code application in this instance, and all applications in Bozeman;s growth.
