Dear City Commissioners, I am writing to express my opposition to Development Application #25238 for Lot 2 at the corners of South 3rd and Little Horse Drive. The proposal must be rejected as it fundamentallyand repeatedly violates the legally binding Planned Unit Development (PUD) and MasterPlan that govern Sundance Springs. This second application fails to comply with the established Covenants and Development Guidelines in several critical areas, including but not limited to: Building Scale Violation: The proposal calls for two, two-story buildings totalingnearly 10,000 square feet. This is a direct violation of the Master Plan, whichexplicitly allows only one, single-story building of less than 5,000 square feet. Prohibited Activity and Use: The inclusion of a large restaurant/bar withextensive outdoor seating/business activities is strictly forbidden by the Master Plan. Furthermore, the proposed density of 7 businesses (including a 2,500 sq ft gymand 100+ seat restaurant) creates a city-wide destination, violating the PUD's mandate for local neighborhood service businesses only. Parking: The plan provides only 51 on-site parking spaces for a usage that may require 150+ spaces. Since the PUD prohibits on-street parking, this deficiency willflood our narrow residential streets with cars, creating safety issues, restricting emergency vehicle access, and violating the PUD's core intent. Given the previous City Commission ruling (4-to-1 on February 27, 2024) overturning the first application, I insist that the City Planning Department uphold the integrity of the PUD. I urge you to reject Development Application #25238 immediately to enforce the existing, legally binding Master Plan. Thank you for considering my objection.
