I am writing this letter as a very strong opponent of The Second Application (25238) for Lot2 Sundance Springs.
I am a homeowner in the neighboring/adjacent Ellis View Estates who will be negativelyaffected by the proposed plan in it’s current form. I am well within sight and earshot of the
proposed development. When I purchased my property in early 2022, it was with completefaith and understanding that the city and any
development on the subject property would be bound by the terms of the Sundance SpringsPUD and Chapter 38 of the BMC- both of which are violated by Site Plan #
25238. Such expectations weighed heavily in my decision to purchase my property over anyother location in Bozeman. I am not opposed to a development that is allowed by the
Sundance Springs PUD or city codes/regulations as they stand. These requirements are clearlyspelled out.
This is the second time that this proposed development has appeared before the City
Commission under appeal. In 2024, the City’s approval of this project was overturned by theBozeman City Commission due to multiple violations.
The second application continues to violate the Sundance Springs PUD, its Master Plan, andestablished City development codes and regulations.
In part- *Proposed parking on Lot 2 violates setback regulations
* Trails owned by Sundance Springs are proposed to be used without homeowners' approval *The land use regulations of adjacent residential neighborhoods will be ignored
*Block Frontage Standards requirements will be violated again, despite the City Commissiondisapproving them in their 2024 appeal decision.
These violations(among others) will be compounded by excessive noise (from an outdoor
patio) and lighting, increased traffic along S. 3rd (a 2 lane stretch of road that is a known deercrossing and frequently used by bikers and runners), overflow parking into adjacent
neighborhoods, etc..CONTRARY TO THE DEVELOPER’S STATEMENTS AT THE LAST APPEALS
MEETING, THE ADJACENT HOMEOWNERS DO NOT AS A WHOLE APPROVEOF/WELCOME THIS DEVELOPMENT IN ITS CURRENT STATE.
As a homeowner in Bozeman I believe that I should be able to count on the City and City
Commission to uphold their own rules and regulations. It is my understanding that attempts inthe past by adjacent homeowners to purchase this property for residential use were turned
down as their proposal did not follow city codes/land usage regulations- this current proposalshould be held to the same standards.
Please, as you did in 2024, overturn the city’s approval of The Second Application (25238)for Lot 2 Sundance Springs . Many of the same violations are still in place and the appeal
should once again be upheld. Compel the developer to follow the Sundance Springs PUD, its Master Plan, and established
City development codes and regulations!
