Bozeman City Commissioners and Ms. Erin George,
Attached are two documents that I hope you will examine while reading
this letter.
The first image is from the Gallatin County Cadastral. One can see the
extensive open space contained in the Sundance Springs PUD, all of
which is owned by the Sundance Springs Residential Owners
Association. We, the Sundance Springs home owners, manage andcontrol the open space that is owned soley by us. Neither the Lot #2
applicant nor the Neighborhood Services Owners Association, of which he
is a member, own or control any of the open land so clearly outlined in the
Cadastral.
I call your attention to Lot #2 on far left (western side) of the Cadastral
image. I have highlighted it with a red boundary. Please note essentially
all of the open space surrounding Lot #2 is owned by the Sundance
Springs ROA. Only one small, narrow strip of land along Little Horse
Street is not owned by our ROA.
The second image is from the applicant's engineering drawings and itshows their plan for meeting the city landscaping/screening requirements.
I have again highlighted the applicant's property boundary in red ink.
The proposed development on Lot #2 is so crowded that it eats up most ofthe setback on the north side of Lot #2 with required parking spaces.
Since the developer cannot satisfy the Bozeman Municipal Code
landscaping standards on his own property, he takes the liberty of
showing the required vegetative screening on our open space land. Thedeveloper also shows two add-ons to our existing bike and walking path.
These trail adds-ons are meant to satisfy the pedestrian orientation and
non-motorized circulation requirements of the B-1 zoning on Lot #2. But
the two trail segments imagined and illustrated by the developer are not
on property he owns or controls. We, the Sundance Springs ROA, own
the open space to the north of Lot #2.
Satisfying City regulations must be accomplished within the boundaries of
the property an applicant owns and controls. It is disingenuous and
inappropriate for the developers to illustrate elements necessary for theirplan approval on property out of their ownership and control. At yet, here
were are... And the Bozeman Development Director has approved it.
Clearly, Lot #2 is not large enough for two large buildings and the parkingand landscaping needed to comply with city standards. I request that you
overturn the approval of this project. I ask that this and all future
developers be made to follow the Master Plan and PUD guidelines calling
for only one commercial building with all BMC and zoning standards beingmet within the boundaries of the lot itself.
I suggest that the commission go on record in their Findings of Fact
against all future proposals of more than one fully compliant commercialbuilding on this lot. By upholding the Master Plan and PUD guidelines on
this lot you will set a precedent for the developers of Lot #1 across Little
Horse Street from the current proposal. It is imperative that we get this
first decision right!
