meeting. At the direction of the City Commission, anonymous public comments are not distributed to
the Board or staff.
Public comments will also be accepted in-person and through video conference during the appropriate
agenda items.
As always, the meeting will be streamed through the Commission's video page and available in the
City on cable channel 190.

This is the time to comment on any non-agenda matter falling within the scope of the Community
Development Board. There will also be time in conjunction with each agenda item for public
comment relating to that item but you may only speak once per topic.
Please note, the Community Development Board cannot take action on any item which does not
appear on the agenda. All persons addressing the Community Development Board shall speak in a
civil and courteous manner and members of the audience shall be respectful of others. Please
state your name, and state whether you are a resident of the city or a property owner within the
city in an audible tone of voice for the record and limit your comments to three minutes.

This board generally meets the first and third Monday of the month from 6:00 pm to 8:00 pm.

SUBJECT:Consider Cancellation or Reschedule of the March 16, 2026 Community
Development Board Meeting
MEETING DATE:February 23, 2026
AGENDA ITEM TYPE:Citizen Advisory Board/Commission
RECOMMENDATION:Consider whether to cancel the March 16th meeting.
STRATEGIC PLAN:7.3 Best Practices, Creativity & Foresight: Utilize best practices, innovative
approaches, and constantly anticipate new directions and changes relevant
to the governance of the City. Be also adaptable and flexible with an
outward focus on the customer and an external understanding of the issues
as others may see them.
BACKGROUND:The MSU spring break is the week of March 16-20th. There are many
persons who travel during this period and obtaining a quorum for the Board
can be challenging. There is an opportunity to cancel the March 16th
meeting or reschedule to March 23rd. There is one project pending which
could be scheduled for March 23rd or April 6th.
Board will discuss and decide to cancel or reschedule the March 16th
meeting.
UNRESOLVED ISSUES:None.
ALTERNATIVES:As identified by the Board.
FISCAL EFFECTS:None, no funds are expended with this action.

SUBJECT:Board Training on the Review of Zone Map Amendments and Appeals of
Administrative Decisions
MEETING DATE:February 23, 2026

RECOMMENDATION:Receive training.
STRATEGIC PLAN:4.1 Informed Conversation on Growth: Continue developing an in-depth
understanding of how Bozeman is growing and changing and proactively
address change in a balanced and coordinated manner.
BACKGROUND:The Montana Land Use Planning Act has modified the procedures for review
of zone map amendments and appeals of administrative decisions. It also
assigns duties to the Community Development Board who serves as the
Planning Commission required by statute. For the first time the Board will
have a role in review of appeals. Staff will providing training to the Board on
the zone map amendment process and the process for hearing appeals of
administrative decisions.
Relevant state law are 76-25-304, Adoption and amendment of zoning
regulations, and 76-25-503, Appeals -- public hearing and notice. Related
municipal code sections are 38.770, Text and Map Amendments and
38.760.030, Appeals.
Appeals are infrequent. Over the past 10 years the City has reviewed 11
appeals of administrative decisions out of thousands processed. Zone map
amendments are much more common with a dozen or so each year.
