February 15, 2025 City of Bozeman Department of Community Development Bozeman City Commissioners Bozeman, MT 59715 RE: Application #25769 Members of the City Commission: As homeowners in Sundance Springs Subdivision, we are in opposition to the Application #25769. We are appealing the decision to allow this plan to move forward. This amended plan does not meet the Sundance Spring Master Plan and PUD requirements that the first plan failed to address. The city did not approve the first plan because of the failure to meet the same discrepancies this new plans allows. WHY? Block frontage standards will be violated despite the commission’s disapproval of them in their 2024 Findings of Fact ad Order of the appeal process. Land use violations being violated will cause other residential neighborhood regulations to be ignotred. Two buildings proposed violate the PUD and Master Plan which allow ONE building of 5000 square feet, not 10,000 square feet this new plan proposes. The bar and restaurant proposed are city wide attractions, not neighborhood services, increasing the activity in our otherwise quiet neighborhood. The traffic through our neighborhood streets would increase. The proposed outdoor patio for dining also increases noise and violates the Master Plan which prohibits outdoor activities. The businesses planned would require 150 parking spaces and only 51 are provided. This puts parking onto Sundance Springs narrow streets where parking is not allowed. This is a SAFETY issue as these streets become narrower as snow builds up in the winter. The plan also encroaches upon Sundance Springs open space surrounding the commercial lot and will increase usage of Sundance Springs trails without homeowners’ permission. We want the Commission to respect the requirements of all Sundance Springs Master plan and PUD requirements. All our neighbors abide by these and SO SHOULD THE CITY.
