HomeMy WebLinkAbout321 N 5th Ave BFD Fire Marshal Unsafe Letter BOZ E MAN MT FIRE DEPARTMENT January 28, 2026 Re: Unsafe Structure Determination Property Address: 321 N 5th Ave, Bozeman, Montana To Whom It May Concern, Following a walk-through by the Bozeman Fire Department, the structure located at 321 N 5th Avenue, Bozeman, Montana, has been determined to constitute an unsafe structure and presents a hazard to life and property. This determination is based on the following observed conditions: 1. Water Intrusion: Evidence of ongoing and significant water intrusion was observed throughout the structure. Prolonged moisture exposure has compromised building materials and contributed to deterioration that adversely affects the safety and stability of the building. 2. Rusted Structural Metal: Multiple structural metal components exhibit advanced corrosion and rusting. This condition reduces load-bearing capacity and structural integrity, increasing the risk of structural failure. 3. Excessive Fire Load: The structure contains a heavy accumulation of demolition debris and combustible materials, creating an excessive fire load. These conditions significantly increase the potential for rapid fire growth and spread and present unsafe conditions for anyone inside, adjacent properties, and emergency responders. Photographs documenting these conditions are attached for reference and are incorporated into this determination. Pursuant to the 2021 International Fire Code, Chapter 1 (Scope and Administration), Section 114.1.1, a vacant structure that is not secured against unauthorized entry shall be deemed unsafe. Unsafe structures shall be taken down and removed or made safe, as the fire code official deems necessary and as provided for in this section. Due to the combined effect of the conditions described above,the structure poses an unreasonable risk of fire, structural failure, and injury.
