Montana Code Annotated:
7-3-315. Presiding officer of commission. The presiding officer of the commission must be:
(1) elected by the members of the commission from their own number for a term established
by ordinance;
(2) elected by the qualified electors for a term of office; or
(3) selected as provided by ordinance.
Anaconda -Deer Lodge County
Section 3. Duties
1. The Anaconda-Deer Lodge County Chief Executive shall be the chief administrative officer of
the local government and shall be responsible for all administrative functions of Anaconda-
Deer Lodge County, unless otherwise provided by this Charter.
2. The Chief Executive’s responsibilities shall be to:
A. Enforce laws, ordinances and resolutions.
B. Direct, supervise, and administer all departments and agencies of Anaconda-Deer
Lodge County.
C. Appoint and remove department heads with the approval of the Commission.
D. Appoint, remove and supervise employees in consultation with the department
heads.
E. Prepare the Commission agenda.
F. Attend Commission meetings unless excused by the Commission and may
participate in discussions.
G. Execute bonds, notes, contracts, and written obligations of the local government,
subject to Commission approval.
H. Prepare and present the budget to the Commission for its approval and execute the
budget adopted by the Commission.
I. Recommend measures to the Commission.
J. Report, as the Commission may require, on the affairs and financial condition of the
local government and prepare and resent written annual report.
K. Recommend revisions of the Administrative Code and Personnel System.
L. Carry out policies established by the Commission and perform other assignments as
required by the Commission.
Butte – Silver Bow County
SECTION 4.02 POWERS AND DUTIES OF THE CIDEF EXECUTIVE
a) The executive and administrative power of the City-County is vested in the Chief Executive.
b) The Chief Executive shall:
1. be accountable for coordinating all community enrichment activities.
2. be accountable for coordinating all Superfund activities, monitoring the funds, and
3. shall interface with a Volunteer Citizen's Advisory Board.
4. enforce ordinances, resolutions and laws;
5. perform duties required by law, ordinance, resolution and this Charter;
6. administer affairs of the local government;
7. carry out policies established by the Council of Commissioners;
8. recommend measures to the Council of Commissioners;
9. report to the Council of Commissioners and the public on the affairs of the local
government at regular meetings of the Council of Commissioners execute bonds, notes,
contracts and written obligations of the government, subject to the approval of the
Council of Commissioners;
10. report to the Council of Commissioners as the Council may require;
11. attend meetings of the Council of Commissioners and may take part in discussion;
12. execute the budget adopted by the Council of Commissioners;
13. appoint, with the advice and consent of the Council of Commissioners, all members of
boards, commissions and authorities; except, the Chief Executive may appoint without
the advice and consent of the Council of Commissioners temporary advisory committees
established by the Chief Executive;
14. establish, for review by the Council of Commissioners, measurable goals and
implementing timetable for the Butte-Silver Bow government that will enhance the
public safety, community livability, environmental quality, transportation system, public
infrastructure, economic development, recreation and other related objectives that will
improve the health, safety, welfare and economy.
15. prepare and publish annually in a local newspaper of paid general circulation, a
summary of the preliminary budget for all major funds and comparisons with the
preceding year budget. Included in the publication shall be the date of the required
public hearing that will provide opportunity for public participation prior to budget
approval by the Council of Commissioners.
c) The Chief Executive may appoint one administrative aide, qualified by training or
experience, to assist in the supervision and operation of the local government; however,
this section shall not affect the appointment of department heads which shall be done
pursuant to Section 4.02 (d) of this Charter. Such administrative aide shall be answerable
solely to the Chief Executive.
d) The Chief Executive:
1. shall have the power to appoint when a vacancy exists and remo~e, for just cause all
non-elected departments heads with the advice and consent of the Council of
Commissioners.
2. shall have the power to hire and fire all other employees of the - local government for
just cause, with the exception of those employees hired by other elected officers, as
provided by law.
3. may, when a vacancy exists, appoint certain designated department heads to serve in
their positions on a contract basis. The terms and conditions of said contracts will be
negotiated by the Chief Executive with the individual involved. These contracts require
approval by the Council of Commissioners. Those department heads so designated shall
be established by ordinance. Early cancellation of all employment contracts must also
be approved by the Council of Commissioners.
e) The Chief Executive may veto ordinances and resolutions subject to override by a two-thirds
(2/3) vote of the whole Council of Commissioners.
f) The Chief Executive shall prepare the budget in consultation with elected and appointed
department heads and submit it to the Council of Commissioners for adoption.
g) The Chief Executive shall exercise control and supervision of all appointed departments and
boards to the degree authorized by ordinance of the Council of Commissioners.
h) It shall be the duty and responsibility of the Chief Executive to require the faithful execution
of this Charter, ordinances, resolutions and laws by all elected and appointed officers.
(i) The Chief Executive shall be responsible for coordinating policies of the Council
of Commissioners with all elected and appointed department heads.
Belgrade:
Section 2.03 Powers And Duties Of The Mayor
A. The mayor shall preside at meetings of the council, shall be recognized as the head of the
city government for all ceremonial purposes and public statements, or may delegate this
duty, and by the governor for the purpose of military law. The mayor shall vote in the case
of tie votes on the council.
B. The mayor shall appoint, with the consent of the council, all members of boards and
committees.
C. The council shall elect from among its members a deputy mayor who shall act as mayor
during the absence or disability of the mayor, and who shall retain his or her power to vote.
D. In the event of vacancy in the mayor's office, the council, by majority vote, shall fill the
vacancy within 60 days, with a qualified voter, until the next regular city election.
Billings:
Section 3.04. Mayor: Election, Powers and Duties.
A. The Mayor shall be a resident and qualified voter of the City of Billings and shall be elected
at large for a term of four (4) years and shall be limited to two (2) consecutive terms.
B. The Mayor shall be the presiding officer of the City Council and shall vote on all issues.
C. The Mayor shall be recognized as the head of City government for all ceremonial purposes
and by the Governor for purposes of military law, and shall execute contracts, deeds and
other documents.
D. The Mayor shall have no administrative duties except as required to carry out the
responsibilities heretofore set forth.
Bozeman:
Section 2.03. Mayor
a) Powers and Duties. The mayor shall be a voting member of the city commission and shall
attend and preside at meetings of the commission; represent the city in intergovernmental
relationships; present an annual state of the city message; add an item to the commission
agenda prepared by the city manager; assign, subject to the consent of commission, agenda
items to sub-committees of the commission; and perform other duties specified by the
commission. The mayor shall be recognized as head of the city government for all ceremonial
purposes and by the governor for purposes of military law but shall have no administrative
duties and shall not interfere with the administration of the city as provided in 2.05(c), below.
The mayor shall not have any appointment power to city boards except where required by state
law.
b) Mayor Elected At Large. At every regular city election the voters of the city shall elect a
mayor at large for a term of four years. The person so elected shall serve as deputy mayor and a
commissioner for the first two years of his or her term, and mayor for the balance of his or her
term of office.
Great Falls:
Section 2 - Powers and Duties of the Mayor.
a) The Mayor shall be recognized as the official head and representative of the City of Great
Falls for the purpose of presiding at City Commission meetings and the performance of
ceremonial functions. These functions of the Mayor shall not be construed as conferring
upon the mayor executive, personnel, or administrative powers or functions.
b) The Mayor shall serve as a member of the Commission with all the rights and privileges of
City Commissioners. The Mayor shall possess no veto over actions taken by the City
Commission.
Helena:
Section 2.04 - Designation, Powers and Duties of the Mayor
1. The mayor shall be elected for a term of four (4) years.
2. The mayor shall be recognized as the official head of the municipality for the purpose of
presiding at city commission meetings, service of civil process, and performing ceremonial
functions.
3. The mayor shall exercise such powers conferred, and perform all duties imposed by this
charter, the ordinances of the municipality and the laws of Montana or the United States.
4. The mayor shall appoint, with the consent of the commission, all members of boards and
committees.
5. The mayor shall communicate to the city commission and to the general public, a statement
of the affairs and management of the city, each January, and may make recommendations
regarding these matters.
6. In the event of vacancy in the office of mayor, the commission shall, by majority vote of the
remaining members, appoint a person eligible to hold such seat to fill the vacancy until the
next regular city election at which time the remainder of the term shall be filled through the
election procedure described in this charter.
Lewistown:
Section 2.09 Chairman of the Commission
The commission members shall select a chairman from the members of the commission.
Missoula:
ARTICLE III. The Mayor
1. The executive. The executive function of the City government shall be exercised by the
Mayor who shall be nominated and elected on a nonpartisan basis by the electors of Missoula.
2. Term of office. The Mayor shall serve a term of four years.
3. Eligibility. Only registered voters who live in the City of Missoula may seek and hold the
office of Mayor.
4. Duties of the Mayor. The Mayor shall execute all ordinances and resolutions passed by the
City Council. The Mayor shall also execute all documents on behalf of the City following
approval by the City Council.
5. Administration. The Mayor shall have the day-to-day responsibility of administering the
affairs of the City. The Mayor may appoint and remove, with the consent of the City Council, all
department City of Missoula Charter heads in accordance with law. The Mayor may appoint and
remove all other department employees in accordance with law. The Mayor shall supervise all
City departments, except the Municipal Court. In the course of administering the City, the
Mayor shall cause to be prepared on an annual basis a report detailing the financial condition of
the City as well as a statement on the operations of the City including progress on programs
and initiatives undertaken in the previous year. Once every three months, the Mayor shall make
a full and complete statement of the financial condition of the City to the City Council.
6. Appointments. The Mayor shall make, with the advice and consent of the City Council, all
appointments to City boards, agencies, authorities and commissions created by the City Council
except those appointments the City Council reserves to itself, or those appointments reserved
to the Mayor exclusively, or those otherwise designated by state law.
7. Annual budget. The Mayor shall present to the City Council, on an annual basis, a budget for
the operation of the City for the City Council's consideration and approval. The budget
presented to the City Council by the Mayor shall indicate in sufficient detail all proposed
services and programs along with the costs thereof. In addition, the budget submitted by the
Mayor to the City Council shall contain an estimated levy of the necessary taxes and fees to
carry out the budgeted activities.
8. Presiding officer of the City Council. The presiding officer of the City Council shall be the
Mayor, who shall decide all tie votes of the City Council, but shall have no other vote. The
President of the City Council shall preside in the Mayor's absence.
9. Vetoes. The Mayor shall have the authority to veto any ordinance or resolution, in whole or
in part, of the City Council. The Mayor shall return any vetoed item to the next regular meeting
of the City Council with any objections in writing. The Mayor's veto is subject to an override by
a two-thirds vote of the full City Council at the next regularly scheduled meeting of the City
Council following issuance of the veto.
10. Assistants to the Mayor. The Mayor has sole discretion to appoint and remove a person or
persons to assist in the execution of the Mayor's duties. The compensation of the person or
persons appointed to assist the Mayor shall be identified in the City's annual budget as adopted
or amended by the City Council.
11. Special meetings. The Mayor may call a special meeting of the City Council when, in the
Mayor's judgment, circumstances warrant such a meeting. At the time a special meeting of the
City Council is called, the Mayor shall state the object of said meeting, and the business of the
meeting must be restricted to the stated object.
Polson:
Section 2.10 Chairman of the Commission
The chairman and presiding officer of the commission shall be the mayor, who shall vote as
other members of the commission and shall not have veto authority. In the absence of the
mayor, the commission shall select a person from among their own number to serve as acting
chairman and presiding officer.
Section 2.11 Other Duties of the Mayor
The mayor shall, be recognized as the principal officer of city government for ceremonial
purposes and shall have no other executive or administrative duties, except as specifically
prescribed by resolution.
West Yellowstone:
Section 3.05 The Mayor: Election, Powers, Duties, Removal and Filling a Vacancy
(1) The mayor shall be selected from among the members of the Town council by the
affirmative vote of a majority of the council.
(2) The council member selected shall serve as the mayor for one year unless selected for an
additional term by the council.
(3) The mayor so selected may be removed by four (4) council member votes, whereupon, a
new mayor shall be selected by the council.
(4) The mayor shall be the presiding officer of the council, shall vote as other council members
and may not veto measures approved by the council. In the absence of the mayor, the council
shall appoint one of the council members present to serve as presiding officer.
(5) The mayor shall be the ceremonial officer of the town and shall have no other duties or
responsibilities except, when required by the council and in the absence of the Town manager,
the mayor shall perform all administrative duties of the Town manager.
(6) The office of mayor shall become vacant upon the death, resignation or removal from office
by any method authorized by law or this charter. A successor mayor shall be appointed by the
council as provided in Section 3.05(1).
Whitefish:
Section 2.02: Powers and Duties Of The Council:
9 . A mayor shall be elected every four (4) years, at large on a nonpartisan basis. The mayor
shall preside at meetings of the council, shall be recognized as the head of the city government
for all ceremonial purposes (or may delegate this duty) and by the governor for the purposes of
military law. The mayor shall have no administrative duties. The mayor shall vote in the case of
