HomeMy WebLinkAbout09 Concept Review Response REF #13 SID Protest Waiver DRAFT WAIVER OF RIGHT TO PROTEST CREATION OF SPECIAL IMPROVEMENT DISTRICTS FOR THE DEPOT ON CHURCH AVE 25709 112 S CHURCH AVE SP CCOA 1/16/2026 FOR VALUABLE CONSIDERATION, the undersigned, being the Owners of the hereinafter described real property, do hereby waive the right to protest the formation of one or more Special Improvement District(s) for: a. Intersection improvements to Church Avenue and Babcock Street including lighting, signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage. In the event an SID is not utilized for the completion of these improvements, the developer agrees to participate in an alternate financing method for the completion of the improvements on a fair share, proportionate basis as determined by square footage of the property, taxable valuation of the property, traffic contribution from the development, or a combination thereof. This Waiver and Agreement is independent from all other agreements and is supported by sufficient independent consideration to which the undersigned are parties and shall run with the land and shall be binding upon the undersigned, their successors and assigns, and the same shall be recorded in the office of the County Clerk and Recorder of Gallatin County, Montana. The real property hereinabove mentioned is more particularly described as follows: The Depot at Church Ave situated in the SE ¼ of Section 7, Township 2 South, Range 5 East, P.M.M.
