CONCURRENT CONSTRUCTION FOR ON-SITE INFRASTRUCTURE
CONCURRENT CONSTRUCTION PROCEDURE (BMC 38.270.030.C)
Whenever any building lots or building sites are created inside the City limits, public infrastructure such
as municipal water distribution systems, municipal sanitary sewer collection systems, streets, and
stormwater collection, treatment, and detention or retention systems must be provided to the lot or
site. If a development is proposed on a site with existing infrastructure and requires public infrastructure
extensions or upgrades on site or directly adjacent to the site, an applicant may request to construct the
public infrastructure and the building at the same time. This is called concurrent construction.
Concurrent construction requires additional review and approval prior to building permit issuance and
must be requested at the time of the initial planning entitlement, such as a site plan or master site plan
application. For off-site infrastructure and subdivision projects follow form CCOFF requirements and
process.
CONCURRENT CONSTRUCTION REQUIREMENTS
Water mains, sewer mains, stormwater system, and streets must meet all of the following
requirements:
1. Any required on-site or directly adjacent extensions of water mains, sewer mains, stormwater system,
or streets to be dedicated to the public:
• Must be located entirely within publicly held easements or rights-of-way
• Must serve only a single lot
• Are the subject of an irrevocable offer of dedication to the City upon completion of the project
• The development is under the control of a single developer who must retain control of the
entire project until final completion
• All work is under the supervision of a single general contractor
• No subdivision of land is involved
2. The DRC must determine when the standards of this subsection BMC 38.270.030.C.1 are met
• The fire department must consider whether adequate fire protection services are available from
existing hydrants, and water supply exists to meet needs during construction
3. Approval of the final engineering design, including location and grade, for the infrastructure project
must be obtained from the engineering department, and the Montana Department of Environmental
Quality when applicable, prior to issuance of any building permit for the development
4. A certificate of occupancy must not be issued until all on-site and off-site water, sewer, stormwater,
and street improvements necessary to serve the site are installed and accepted or approved as
applicable by the City.

APPLICATION SET
Materials required with the initial site plan application:
Initial concurrent construction plan:
• A phasing plan labeled “Concurrent Construction Plan” that illustrates and delineates the extent
of each phase, the timing of each phase, the proposed timing of the infrastructure installation
and building construction (include proposed sequencing of each building and any associated
structures such as trash enclosures in each phase if applicable), the proposed timing of other
site improvements such as parking areas, pedestrian circulation, and open space.
• A phasing plan that illustrates the proposed occupancy for each phase and each building and
any associated structures such as trash enclosures that clearly shows how and when the
infrastructure will be complete for each phase prior to the occupancy of any building.
• All proposed phasing plans must include both on and adjacent off-site improvements: all on-site
improvements plus any improvements to streets, sidewalks, and any improvements within the
rights-of-way adjacent to the site. All improvements must be accounted for and shown within a
proposed phase.
• All phasing plans must show all property lines, streets, rights-of-way, site circulation and parking
areas, pedestrian facilities, open space areas, buildings and structures, utilities, infrastructure,
easements, construction staging, construction fencing, and clearly delineated phasing lines.
Materials required following the approval of the planning application and the preliminary concurrent
construction approval by the Development Review Committee:
1. Final Concurrent Construction Plan, materials as required above, in final form and revised.
2. City Infrastructure Approval
3. DEQ Infrastructure Approval
4. Written approval by City Fire Marshal
5. Irrevocable Offer of Dedication
All materials must be submitted and approved prior to issuance of a building permit.
FORMAL ACKNOWLEDGMENT
By requesting Concurrent Construction (CCON), the applicant is responsible for understanding and
adhering to the Bozeman Municipal Code (BMC Sec. 38.270.030.C) throughout the project development.
The applicant understands and accepts the risk in application approval delays if the Concurrent
Construction application does not satisfy all requirements of the BMC. The applicant acknowledges that
by submitting Concurrent Construction he/she agrees:

criteria as adopted by the City.
• Building permits will not be issued until all the required materials in the application set are
provided and approved by the Development Review Committee.

Rocky Mountain Flats Concurrent Construction Narrative
The following narrative and enclosed exhibits are intended to explain, first, why concurrent
construction is believed to be a realistic option for this project and, second, how the project
construction would be phased to accommodate concurrent construction.
BMC38.270.030.C.1 outlines the requirements for “completion time for site development” in the City
of Bozeman in regards to the completion of the public improvements that may be necessary to serve
the project. Section C explains that in order to for building permits to be issued on a given project,
either subsection (a) of Section C.1 needs to be satisfied, or both subsections (b) and (c) need to be
satisfied.
The following narrative lists the requirements of subsection C.1 and provides responses indicating
how both subsections (b) and (c) are being met:
1. Provision of municipal central water distribution, municipal sanitary sewer collection
systems, streets, and stormwater systems means that the criteria in either subsection a or
subsections b and c are met as follows:
a. Water, sewer, stormwater, and street services are installed and accepted by the city with
service stubs being extended into the site, with such stubs being of adequate size to
provide water and sewer service to the proposed development without modification to
publicly owned infrastructure; or
The requirements of this subsection are not met. This development will require street
extensions and water and sanitary sewer main extensions onto the project site in order to
serve the proposed building and extend the city street and utility grid.
b. The water mains, sewer mains, stormwater system, and streets to be extended to provide
service to the development are: located within a publicly dedicated right-of-way or
easement; constructed to city standards; physically adjacent to the site proposed for
construction; installed and accepted by the city; and adequate in capacity to provide
necessary service to the proposed development; and
This provision is met. Four existing streets (Fowler Lane, Edgerton Avenue, Gabriel Avenue,
and Meah Lane) and their associated water, sewer, and storm mains need to be extended into
and across the site to both serve the proposed development and extend the city street / utility
grid. All of these streets are currently within public right-of-way or easements and are stubbed
to the subject property boundary. Therefore, the required public improvements that are
necessary to serve the project will be confined to the project site or the street right-of-way
directly adjacent to the project site. No oƯ-site extensions of streets or utilities are proposed
to serve the project, Furthermore, during initial project review, the city did not identify any oƯ-
site streets or utilities that will need to be upsized to serve the project.
c. Water mains, sewer mains, stormwater system, and streets must meet all of the
following requirements:
1) Any required on-site or oƯ-site extensions of water mains, sewer mains, stormwater
system, or streets to be dedicated to the public: must be located entirely within
publicly held easements or rights-of-way; must serve only a single lot; are the subject
of an irrevocable oƯer of dedication to the city upon completion of the project; the
development is under the control of a single developer who must retain control of the
entire project until final completion; all work is under the supervision of a single general
contractor; and no subdivision of land is involved;
- This provision is met. All required public street and utility extensions will be within public
street and utility easements that will be dedicated to the city prior to site plan approval.
- Since this property is a single lot and no subdivision is proposed, the required utility
extensions will serve only a single lot.
- An irrevocable oƯer of dedication of the public improvements to the city, can be provided,
if necessary.
- The development is under control of a single developer who will also be the general
contractor for the entire project.
- No subdivision is proposed.
2) The DRC must determine when the standards of this subsection C.1 are met. The fire
department must consider whether adequate fire protection services are available
from existing hydrants, and water supply exists to meet needs during construction. If
adequate fire protection does not exist then concurrent infrastructure and
development construction may not occur. Based on evaluation by the fire department,
simultaneous construction of infrastructure to be dedicated to the public and private
development construction may be permitted only within a defined portion of the site;
Understood. The following background is provided for consideration regarding access and
fire protection.
Currently the site can be accessed from Fowler Lane to the west, Edgerton Avenue and
Gabriel Avenue to the north, and Meah Lane / 31st Avenue to the east, providing existing
access opportunities from 4 public streets on 3 sides of the property during construction.
There are also operable fire hydrants along the property boundary at each of these streets,
providing 4 operable fire hydrants in the vicinity of the site. Furthermore, each of the
proposed buildings is within 100’ of at least one of these existing hydrants. The enclosed
Exhibit 1 outlines the existing access and hydrant locations in relation to the proposed
buildings.
The goal of the applicant is to be able to proceed with foundation work on the proposed
buildings while the on-site water main extensions are being constructed. Then, once the on-
site water mains and associated hydrants are operable, vertical construction on the
buildings could begin. The following concurrent construction plan outlines a method to
maintain gravel access throughout the project site so that water main installation can take
place concurrently with the foundation work while maintaining adequate emergency
access.
The possibility of proceeding with construction of the on-site infrastructure concurrently
with the proposed buildings was discussed with the Fire Marshal. He explained that, in
addition to the 4 existing public accesses and hydrants, gravel access roads through the site
would also need to be maintained throughout construction between these existing hydrants
and the proposed buildings. He was however, of the opinion that the 4 existing fire hydrants
could be suƯicient for emergency activities during foundation work.
During discussion with the city engineering department, it was noted that water pressure in
this area of the city is generally low, and the existing hydrants may not provide suƯicient
pressure and capacity to support firefighting activities during vertical building construction.
It should be noted, however, that these same hydrants were recently installed with the
BuƯalo Run development to the north of the project site and were deemed to be suƯicient
to allow for concurrent construction of the multi-story apartment buildings associated with
that project. The buildings proposed with the Rocky Mountain Flats project are, admittedly,
substantially larger than those constructed with the development to the north, which is why
it is understandable that on-site hydrants would need to be operational prior to the start of
vertical construction. However, it is believed that the existing hydrants would be suƯicient
for firefighting activities during foundation work.
3) Approval of the final engineering design, including location and grade, for the
infrastructure project must be obtained from the engineering department, and the
Montana Department of Environmental Quality when applicable, prior to issuance of
any building permit for the development; and
This is understood and this provision will be met. The infrastructure improvements submittal
for the public improvements is under review at the city engineering department and will be
sent to DEQ for review once approved by the city.
4) A certificate of occupancy must not be issued until all on-site and oƯ-site water, sewer,
stormwater, and street improvements necessary to serve the site are installed and
accepted or approved as applicable by the city.
This is understood.
Rocky Mountain Flats Concurrent Construction Plan
Phase 1
PRIOR TO PHASE 1 INITIATION:
a. Receive site plan approval.
b. Receive Infrastructure Approval from COB and DEQ and complete pre-
construction meeting.
Install roadway sediment control and traƯic control at both existing driveways on the west
side of the site from Fowler Lane.
Install erosion control along the perimeter of the site.
Demo structures and septic system.
Re-align ditch on west side of Fowler Lane and complete diversion from east ditch into west
ditch.
Phase 2
PRIOR TO INITIATION OF PHASE 2:
a. Receive Building Permit Approval / Issuance
Strip topsoil and prep road subgrades to provide gravel access roads along proposed street
sections for site access.
CONSTRUCTION ACCESS TO SITE TO COME FROM FOWLER LANE. GRAVEL ACCESS IS TO
BE MAINTAINED TO EXISTING EDGERTON AVE, GABRIEL AVE AND MEAH LANE STREET
STUBS AND ASSOCIATED FIRE HYDRANTS FOR EMERGENCY USE.
Install storm ponds on northern property boundaries for runoƯ control during construction.
Install water and sewer main in Fowler Lane.
Contractor to Phase Fowler utility work so access to the site from Fowler Lane for
construction and emergency vehicles is maintained at all times. Utilize existing driveways as
temporary construction entrances as necessary to maintain access to site during Fowler
utility work.
Restore Fowler Lane to county gravel standard and open to public until paving occurs.
Strip topsoil from building B and C footprints and parking lots and prep parking lot gravel
subgrades to create stabilized construction staging areas.
Once gravel access roads are provided across site, begin foundation work on Buildings
B and C.
NO VERTICAL BUILDING CONSTRUCTION TO BEGIN UNTIL ON-SITE WATER MAINS AND
ASSOCIATED FIRE HYDRANTS ARE OPERABLE.
Phase 3
Install water main across site in future Meah Lane.
Contractor to Phase water main work in future Meah Lane so gravel access to each building
for construction and emergency vehicles is maintained at all times.
Once Fowler utility work is completed and reliable site access can be provided from Fowler,
strip topsoil from building A footprint and parking lot and prep parking lot to gravel subgrade
to create construction staging area.
Begin foundation work on Building A.
NO VERTICAL BUILDING CONSTRUCTION TO BEGIN UNTIL ON-SITE WATER MAINS AND
ASSOCIATED FIRE HYDRANTS ARE OPERABLE.
Phase 4
Complete water main with installation of water main in Edgerton Ave and Gabriel Ave.
Once water main installation is complete, charge, chlorinate, flush, and pressure test all
water main in coordination with City Water Department.
Hold walkthrough with city water department and turn on water main for emergency use
during construction.
NO VERTICAL BUILDING CONSTRUCTION TO BEGIN UNTIL ON-SITE WATER MAINS AND
ASSOCIATED FIRE HYDRANTS ARE OPERABLE.
Phase 5
Begin vertical building construction.
Install remaining utilities in proposed streets and parking lots as necessary to begin prepping
streets and site with gravel for curb and gutter.
Utilities installed in this phase to include: sanitary sewer, storm sewer and associated
systems, utility sleeves, utility culverts, underground power and gas.
Prep streets and parking lots with gravel subbase and base courses.
Contractor to phase work so gravel access to each building is maintained at all times.
Phase 6
Hold pre-pave walkthrough with city engineering, roads, water & sewer departments.
Complete curbing, paving and concrete flatwork for street and site improvements.
Continue vertical construction on buildings.
Phase 7
Complete remaining site and street improvements such as signage, striping and street
lighting.
Complete exterior building shells. Continue interior construction.
Hold Final Walkthrough with city engineering, roads, water & sewer departments. Submit
infrastructure as-built & close-out package.
Open streets & turn over public utilities to City.
Phase 8
Complete finish grading and landscaping around buildings, park, and open space areas.
Remove perimeter erosion control measures once adjacent landscaping is complete and site
is stabilized.
Consolidate construction activity and staging areas to building parking lots.
Continue internal building construction.
Submit engineer and architects certification letters of completion of site improvements.
Turn over buildings for occupancy on individual basis as they are completed and the
surrounding landscaping and site improvements associated with each building are
completed.
o Phase 8A
Receive Certificate of Occupancy for Building C.
Building C parking lot and adjacent open space areas are open.
All city streets are open.
Constructions activity and staging areas for Buildings A and B are limited to
the parking lots of those buildings.
