COMMISSION RESOLUTION NO. 2684
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, EXTENDING THE BOUNDARIES OF SAID CITY
OF BOZEMAN SO AS TO INCLUDE A TRACT OF LAND CONTIGUOUS
TO SAID CITY AND REFERRED TO AS THE SACCOCCIA ANNEXA-
TION, HEREI N MORE PARTICULARLY DESCRIBED, WITH IN THE
CORPORATE LIMITS THEREOF.
WHEREAS, the City of Bozeman received a request for the annexation of Tract 1 of
Certificate of Survey No. 1215 from its sole owner, Philip J. Saccoccia, Jr.; and
WHEREAS, a staff report on said Tract 1 of Certificate of Survey No. 1215 recom-
mended annexation upon execution of an Annexation Agreement between the City of Bozeman
and the owner of said Tract 1; and
WHEREAS, Commission Resolution No. 2644 was adopted by the City Commission on
December 29, 1986, declaring it to be the intent of the City of Bozeman to extend the boun-
daries of said City so as to include said contiguous tract within the corporate limits of the
City; and
WHEREAS, a typographical error in Commission Resolution No. 2644 erroneously desig-
nated Tract 1 of Certificate of Survey No. 1215 as Tract A, with there being no Tract A
in said Certificate of Survey No. 1215; and
WHEREAS, a public hearing on Commission Resolution No. 2644 was duly noticed and
held on February 2, 1987; and
WH EREAS, on February 9, 1987, the Commission voted to approve the intent to an-
nex the tract as established in Commission Resolution No. 2644; and
WHEREAS, no objection to said annexation has been raised; and
WHEREAS, provision for services to said contiguous tract is the subject of a written
agreement between the City of Bozeman and Philip J. Saccoccia, Jr., record owner of the
tract, dated September 28, 1987; and
WHEREAS, said contiguous tract is described on Certificate of Survey No. 1215,
which is duly recorded in the office of the Clerk and Recorder of Gallatin County, Mon-
tana;
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Boze-
man, Montana:
Section 1
That it is hereby declared that pursuant to Title 7, Chapter 2, Part 43, M. C. A. ,
the following described property which is contiguous to the municipal boundaries of the
City of Bozeman be annexed to the City of Bozeman and that the boundaries of said City
shall be extended so as to embrace and include such properties, to wit:

Tract 1 of Certificate of Survey No. 1215, being a tract of land situated in
the NW~ of Section 1, Township 2 South, Range 5 East, P.M.M., Gallatin
County, Montana.
Sect ion 2
The effective date of this annexation is January 7, 1988.
Section 3
The annexation of the Saccoccia Annexation is subject to the terms of the Agreement
dated September 28, 1987 by and between the City of Bozeman and Philip J. Saccoccia, Jr.,
record owner of the tract, regarding the provision of services.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana,
at a regular and stated session of said City Commission, held on the 7th day of December
1987.
