Offer of Dedication
This Irrevocable Offer to Dedicate and Declaration of Restrictions(hereinafter"Offer")is
made this 5%day of bl0%)EMB Ed.2025,by Alpenglow ofBozeman,LLC,13167 County
Highway 00,Chippewa Falls,WI 54729 (hereinafterreferredtoas "Grantor").
WHEREAS,Grantor isthelegalowner in simple feeinterestof certainrealpropertieslocated
intheCounty ofGallatin,Stateof Montana,and describedasLot 1,Block 1 South University District
Phase 3 Major Subdivision (PlatJ-695),on fileand of recordintheofficeof theClerk and Recorder
of saidCounty (hereinafterreferredto as the "Property")and
WHEREAS,Grantor appliedto the City of Bozeman (the "Municipality")for approval to
undertake development as definedin Chapter 38.7,BMC withinthe City of Bozeman (hereinafterthe
"Permit");and
WHEREAS,approvalof Application23263 was grantedon April 3,2025,by the
Municipalityin accordance with theprovisionsof Title38,BMC,hereby incorporatedby reference;
and
WHEREAS,Grantor wishes to meet the requirements of Title38,BMC,to provide public
accessand/or allow simultaneous constructionof infrastructureand improvements which willlaterbe
grantedto theMunicipality,with thebuildings,remaining improvements and landappurtenantthereto
toremain inprivateownership,as authorizedin Section38.270.030.C;and
WHEREAS,thewater and sewer improvements and streetinfrastructureappurtenantto and to
be installedor constructedon or under the above describedlands,and infrastructureand/or interests
thereinare to be dedicatedto the Municipality,freeand clearof allencumbrances,pursuant to said
finalapproval of thePermit;and,
WHEREAS,itisintendedthatthisOffer isirrevocableand shall,upon writtenacceptance by
the Municipalityand finalapproval of the Permit referencedherein,grantallrightsof use or access
formaintenance and repairof the saidimprovements and infrastructureoffered;
NOW THEREFORE,in considerationof the granting of,and conditioned upon,the final
approval forapplicationno.23263,the Grantor hereby offersto dedicatetothe
Municipality,the sewer and water improvements and streetinfrastructureconstructed or be
constructedupon the realpropertyas specificallysetforth,described and identifiedin the plans and
specificationsissued or prepared by Stahly Engineering &Associates,INC.851 Bridger Drive,
Suite 1 Bozeman,MT ProjectENGINF-10671 dated January 29,2025 (with subsequent approved
revisions),which areby thisreferenceincorporatedin thisinstrument.

1.Benefitand Burden.This Offershallrun with and burden thePropertyand all
obligations,terms,conditions,and restrictionsherebyimposedshallbe deemed tobe covenantsand
restrictionsrunningwiththelandand shallbe,upon theissuanceofthefinalPermitreferenceherein,
be effectivelimitationson theuse and accessofthePropertyby Grantorand shallbindtheGrantor
and allsuccessorsand assigns.This Offershallbenefitthe Municipalityonly so long as said
improvementsand infrastructuresforsewerand waterexiston theProperty.
2.Constructionand Validity.Ifany provisionoftheseRestrictionsisheldtobe
invalidorforany reasonbecomes unenforceable,no otherprovisionshallbe therebyaffected
orimpaired.
3.Successors and Assigns.The terms,covenants,conditions,exceptions,
obligations,and reservationscontainedinthisOffershallbe bindingupon and inuretothe
benefitofthesuccessorsand assignsofboththeGrantorand theMunicipality,whether
voluntaryorinvoluntary.
4.Limitations.The constructionandotherstandardsadoptedorutilizedby theCity
ofBozeman regardinglegalform,constructionmaterials,warranty,and allotherelements
relatingtoimprovementsorinfrastructureconstructedorbe constructedpursuanttothePermit
shallbe fullyapplicable.
5.Term.ThisirrevocableOfferofDedicationshallbe bindingforthedurationof
FinalSitePlanapprovalprocess.Upon writtenacceptanceofthisOfferby theMunicipality,this
Offerand theterms,conditions,and restrictionshereofshallexistinperpetuity,shallhavethe
effectofa grantby Grantor,subjecttotheconditionsstatedherein,and shallrunwiththeland
and be bindingon theparties,theirheirs,assigns,and successors,PROVIDED,HOWEVER,
thisgrantshallbe nulland voidifthePermitreferencedhereinisnotgrantedand issuedby the
Municipalityon orbeforeoneyearafterthedateofFinalPlanapprovalorextensionsofthedate
of approval.
