WATER PIPELINE AND ACCESS EASEMENT AND AGREEMENT
Montana StateUniversity-Bozeman,theGRANTOR,inconsiderationof $1.00 and othergood
and valuableconsideration,receiptof which isacknowledged,grant(s)toThe CityofBozeman,
a municipalcorporationoftheStateofMontana,with officeat 121 North Rouse Avenue,
Bozeman Montana 59715,GRANTEE,itssuccessorsand assigns,a perpetualeasement to lay,
constructand maintainwater pipelineswiththeusualservices,valves,connections,accessories
and appurtenancesforthepurposeoftransmittingwater in,through,and acrossa stripof land
situatedinGallatinCounty,Montana,thirty(30)feetwide tobe locatedon thefollowing
describedrealproperty:
The Abandoned Portionof 10thAvenue South (PlatC-37)and Lots 25 and 26,Block 7 of
CapitalHillAddition,locatedintheNortheastOne-Quarterof Section13,Township 2
South,Range 5 East,PrincipalMeridian Montana,Cityof Bozeman,GallatinCounty,
Montana.
The easement ismore particularlydescribedon theattachedExhibit"A"which by this
referencearemade a parthereof.
Thisgrantincludesthe rightof theGRANTEE (BZN),itssuccessors,and or assigns,to
enteratalltimesupon theabove-describedlandby usingexistingroadsor trailsorotherwiseby
a routecausingthe leastdamage and inconvenienceto theGRANTOR (MSU)inorderto:
operate,repair,replaceand maintainthe pipeline,services,connections,accessoriesand
appurtenances;trim,remove,destroy,or otherwisecontrolany treesand brush insideor outside
theboundariesoftheeasement which may,intheopinionofthe GRANTEE (BZN),interfereor
threatento interferewith or be hazardoustotheoperation,maintenance,orreplacementof the
pipeline;
GRANTEE (BZN)agreesthat,inconnectionwith the-operating,repairing,replacing,and

maintainingof saidwater pipeline,itwillrepairor replace,atitssoleexpense,orpay to
GRANTOR (MSU)thereasonablevalueof any damages togrowing crops,existingfences,
ditchesand otherappurtenancesofsaidlandthatmay be disturbedby itsoperation.
GRANTOR (MSU)may relocatethe Easement ifintheopinionof GRANTOR (MSU)it
unreasonablyinterfereswiththe presentorfutureuse by GRANTOR (MSU)of GRANTOR'S
(MSU)land.GRANTOR (MSU)shallprovideto GRANTEE (BZN)a substituteeasement area
asreasonablysuitedtoGRANTEE'S (BZN)needs inorderto sufficientlymaintain,operate,or
replacethewater pipeline.Relocationshallbe atGRANTOR'S (MSU)solecostand expense.
GRANTOR (MSU)willthendraftforGRANTEE (BZN)review and signature,thenecessary
easement modificationagreements(s)to facilitatesuch relocation.
GRANTOR (MSU)may terminatethisEasement and allof therightsgrantedhereinif
thewater main and appurtenancesaretaken outof service,abandoned,relocated,orremoved.
GRANTOR (MSU)shallnotifyGRANTEE (BZN)2-yearspriortoterminationoftheeasement
ifthe pipelineistobe relocatedand 1-yearpriortoterminationifthepipelineistobe
decommissioned or removed.Any and allinterestinGRANTOR'S (MSU)landconveyed inthis
Easement shallautomaticallyreverttoGRANTOR (MSU)or itsassignsand successors.
GRANTOR (MSU)may remove orabandon in-placeany and allimprovements itor GRANTEE
(BZN)installedin,on,under or above theeasement areaatGRANTOR'S (MSU)solecostand
expense.GRANTOR (MSU)willthendraftforGRANTEE (BZN)review and signature,the
necessaryeasement modificationagreement(s)or releaseoftheEasement.
GRANTOR (MSU)warrantsthattheyarelawfullyseizedand possessedof thereal
propertydescribedabove,thattheyhave a lawfulrighttoconvey theproperty,or any partof it,
and thattheywillforeverdefendthetitletothispropertyagainsttheclaimsofallpersons.At no
time willGRANTOR build,construct,erect,ormaintainany permanent structurewithinthe
boundariesof saideasement withoutthepriorwrittenconsentofGRANTEE.
GRANTEE (BZN)may peaceablyhold and enjoytherightsand privilegeshereingranted

withoutany interruptionby theGRANTOR (MSU).The terms,covenantsand provisionsofthis
easement and agreement shallextendtoand be bindingupon theheirs,executors,administrators,
personalrepresentatives,successorsand assignsofthe partieshereto.
