Offer of Dedication
This IrrevocableOffer toDedicate and Declarationof Restrictions(hereinafter"Offer")is
made this $ay of ocTB8ee_2025 by Rustic Home,LLC (hereinafterreferredto as
"Grantor").
WHEREAS,Grantor isthelegalowner insimplefeeinterestof certainrealpropertieslocated
intheCounty of Gallatin,StateofMontana,and describedas
Tract2A,Amended Kirk SubdivisionofPlatF-1-D
Located inthe SE 1/4of Section11,T.2 S.,R.5 E.of P.M.M.,
Cityof Bozeman,GallatinCounty,Montana
on fileand ofrecordintheofficeof theClerk and Recorder of saidCounty (hereinafterreferredto as
the "Property")and
WHEREAS,Grantor appliedto the City of Bozeman (the"Municipality")forapprovalto
undertakedevelopment asdefinedinChapter38.7,BMC withintheCityofBozeman (hereinafterthe
"Permit");and
WHEREAS,approvalof SitePlanApplication#22-341 was grantedon 10/11/_16z_,by the
Municipalityinaccordancewith theprovisionsof Title38,BMC,hereby incorporatedby reference;
and
WHEREAS,Grantor wishes to meet the requirementsof Title38,BMC,to provide public
accessand/orallow simultaneousconstructionofinfrastructureand improvements which willlaterbe
grantedtotheMunicipality,withthebuildings,remainingimprovements and landappurtenantthereto
toremain inprivateownership,as authorizedinSection38.270.030.C;and
WHEREAS,thewaterand sewer improvements and streetinfrastructureappurtenanttoand to
be installedor constructedon or under theabove describedlands,and infrastructureand/orinterests
thereinareto be dedicatedto theMunicipality,freeand clearof allencumbrances,pursuantto said
finalapprovalofthePermit;and,
WHEREAS,itisintendedthatthisOfferisirrevocableand shall,upon writtenacceptanceby
the Municipalityand finalapprovalof the Permit referencedherein,grantallrightsof use or access
formaintenance and repairof thesaidimprovements and infrastructureoffered;
NOW THEREFORE,in considerationof the grantingof,and conditionedupon,the final
approvalforapplicationno.22-341 theGrantorherebyofferstodedicatetothe
Municipality,the sewer and water improvements and streetinfrastructureconstructedor be
constructedupon therealpropertyas specificallysetforth,describedand identifiedinthe plansand
specificationsissuedor prepared by IMEG Consultants Corp.Bozeman,MT ProjectENGINF
12179 dated8/20/2025(withsubsequentapproved revisions),which areby thisreferenceincorporated
inthisinstrument.

1.Benefit and Burden.This Offer shallrun with and burden the Property and all
obligations,terms,conditions,and restrictionshereby imposed shallbe deemed to be covenantsand
restrictionsrunningwith the landand shallbe,upon the issuanceof thefinalPermitreferenceherein,
be effectivelimitationson theuse and accessof thePropertyby Grantorand shallbind the Grantor
and allsuccessorsand assigns.This Offer shallbenefitthe Municipalityonly so long as said
improvements and infrastructuresforsewer and water existon theProperty.
2.Construction and Validity.Ifany provisionof theseRestrictionsisheldto be
invalidor forany reason becomes unenforceable,no otherprovisionshallbe therebyaffected
or impaired.
3.Successors and Assigns.The terms,covenants,conditions,exceptions,
obligations,and reservationscontainedin thisOffer shallbe binding upon and inureto the
benefitof the successorsand assigns of both the Grantor and the Municipality,whether
voluntaryor involuntary.
4.Limitations.The constructionand otherstandardsadoptedorutilizedby theCity
of Bozeman regardinglegalform,constructionmaterials,warranty,and allother elements
relatingto improvements or infrastructureconstructedor be constructedpursuanttothePermit
shallbe fullyapplicable.
5.Term.This irrevocableOfferofDedicationshallbe bindingforthe durationof
FinalSitePlanapprovalprocess.Upon writtenacceptanceofthisOfferby theMunicipality,this
Offerand theterms,conditions,and restrictionshereofshallexistinperpetuity,shallhave the
effectof a grantby Grantor,subjecttotheconditionsstatedherein,and shallrun with the land
and be bindingon theparties,theirheirs,assigns,and successors,PROVIDED,HOWEVER,
thisgrantshallbe nulland void ifthePermitreferencedhereinisnot grantedand issuedby the
Municipalityon orbeforeone yearafterthedateof FinalPlanapprovalorextensionsofthedate
ofapproval.
