MUTUAL ACCESS EASEMENT AND AGREEMENT
This Easement and Agreement isestablishedthis /day of CTo86/L ,2025,by and
between FIFTEEN ON 20™,LLC.,and RUSTIC HOME,LLC,both Montana limitedliability
companies.
RECITALS:
WHEREAS,FIFTEEN ON 20™,LLC isthe recordowner ("Owner")of Tract 1A,Amended
Kirk Subdivision,[PlatF-1-D],on fileand of record in the officeof the Clerk and Recorder,
GallatinCounty,Montana,and locatedinthe SE 1/4of Section11,T.2 S.,R.5 E.of P.M.M.,
City of Bozeman,GallatinCounty,Montana;
and
WHEREAS,RUSTIC HOME,LLC.istherecordowner ("Owner")of Tract2A,Amended Kirk
Subdivision,[PlatF-1-D],on fileand of recordinthe officeoftheClerk and Recorder,Gallatin
County,Montana,and locatedinthe SE 1/4 of Section11,T.2 S.,R.5 E.of P.M.M.,City of
Bozeman,GallatinCounty,Montana.
and
WHEREAS,the Owners have determined thatitisin theirbestintereststo establisha mutual
accesseasement forthe development of the lotsdescribedabove,being Tract 1A and Tract2A,
Amended Kirk Subdivision,[PlatF-1-D],on fileand of record in the officeof the Clerk and
Recorder,GallatinCounty,Montana,and locatedinthe SE 1/4of Section11,T.2 S.,R.5 E.of
P.M.M.,Cityof Bozeman,GallatinCounty,Montana.
NOW,THEREFORE,a mutual accesseasement for a common driveway and for ingressand
egressishereby establishedas shown and dimensioned on the attachedEXHIBIT A,which by
thisreferenceismade a partof thisdocument.
THAT thiscommon mutual accesseasement shallbe a perpetualeasement and shallbe superior
to and paramount to the rightsof any of the subsequent owners of said propertiesand the
respectiveservientestatesso created.The Owners furtherstatethatthiseasement isa covenant
thatshallrun with the land,and shallbe for the benefitof and inure to the Owners,their

successorsand assigns,theiragents,employees,tenants,and guestsof tenants,and shallburden
theirrespectiveparcels,perpetually.
THAT theOwners and theirheirsand assignsshallbe responsibleforthemaintenance and repair
of theirrespectiveportionsof the shared access,includingthe streetapproach and public
sidewalk.
THAT each subsequent owner and theirheirsand assignsshallhold the otherpartyharmless
from any liabilityresultingfrom the use of the mutual accessfor ingressand egressto their
respectiveproperties.
THAT the mutual access easement shall remain free and clear at all times from all
encumbrances.
The Owners have executedthismutual accesseasement and agreement on theday and year first
writtenabove.
