Said temporary constructioneasement islocatedon the west side of North 27thAverme betweenBaxterLaneandCattailStreetandisdepictedonExhibitAattachedheretoandmoreparticularlydescribedonsaidExhibit
Defineated as to said tractof land on the exhibitattached hereto and made a part hereof asExhibitAofthisinstrument.Said parcel,containing871.2 square feet,more or less,isherebytemporarilyprovidedtotheGRANTEE,forthe purpose ofconstructingand/or improving a publicstreet,highway,walkway,trailand/or electric,telephone or telecommunications,gas,water,sewer,drainage,or other utilitytransmissionor distributionfacilitiesas necessary forthe N.27thAvenue(Baxterto Cattail)Project.The GRANTEE shallprovidea 1-inchdomestic water servicestubanda4-inch sanitarysewer servicestub to the south of newly installedwater and sewermainstubsasidentifiedintheplansfortheN.27thAvenue (Baxterto Cattail)Project.Uponcompletionofsaidprojectforwhichaccessisherebyprovided,the GRANTEE shallrestorethe
propertyas nearlyas possibleto itsoriginalconditionwiththe exceptionof providinga minimumof12'compacted asphaltroad to the southwest ofthe provided access ofthe futureextensionofKimberwickeStreettothewest.Asphalt road istomatch width and tieintoexistingaccess roadasidentifiedintheplansfortheN.27thAvenue (Baxterto Cattail)Project.The GRANTEE agreestoholdGRANTORharmlessfromanyandallliabilitythatmayresultorarisefromtheexerciseoftherightsgrantedhereby.
