TEMPORARY CONSTRUCTION EASEMENT
The GALLATIN CENTER LIMITED PARTNERSHIP,whose address isP.O.Box 906,Bozeman,
MT 59771,for and in consideration of One and No/100 -Dollars,and other valuable
consideration,in hand paid,grants to the GRANTEE,the City of Bozeman,a Municipal
Corporation of the State of Montana,with officesat 121 North Rouse Avenue,Bozeman,
Montana,59715,itssuccessors or assignees,an unrestrictedTemporary ConstructionPermit in,
over,under,along,though,and across the followingdescribed realpropertylocatedin Gallatin
County,Montana:
Remainder of Lot 3 of Minor SubdivisionNo.210 situatedin the southeast ¼of Section 35,
Township 1 South,Range 5 East,PrincipalMeridian,Cityof Bozeman,Montana.
Said temporary constructioneasement islocatedon the east side of North 27thAvenue between
Baxter Lane and CattailStreetand isdepictedon ExhibitA attachedheretoand more particularly
described on said Exhibit
Delineated as to said tractof land on the exhibitattached hereto and made a part hereof as
Exhibit A of this instrument.Said parcel,containing 5.00 Acres,more or less,is hereby
temporarilyprovided to the GRANTEE,forthe purpose ofconstructingand/or improving a public
street,highway,walkway,trailand/or electric,telephone or telecommunications,gas,water,
sewer,drainage,or other utilitytransmissionor distributionfacilitiesas necessary forthe N.27th
Avenue (Baxterto Cattail)Project.The Grantee willrequireitscontractorto coordinatewithany
constructionwork thatislocatedwithinor near the constructioneasement area so as work can
occur simultaneouslyforthe Grantee's projectand projectthatthe Grantor might have.In the
event the proposed park locatedon the NE cornerof N27th and Rawhide Ridge Road (parkarea)
isrequiredto be constructedpriortothevacationofthe corresponding constructioneasement the
constructionequipment,materialand debriswillbe removed from the park area and the park area
willbe leftclean with a uniform slope,graded smooth conditionand stabilizedto the roadway
proposed finishgrade at back of sidewalk to edge of wetland setback.Upon completion of said
projectforwhich access is hereby provided,the GRANTEE shallrestoreallareas withinthe
constructioneasement and willbe leftin clean conditionwith a uniform 4:1 max slope,graded
smooth conditionand stabilized.

The GRANTEE agrees to hold GRANTOR harmless from any and allliabilitythatmay resultor
arisefrom the exerciseof the rightsgranted hereby.
GRANTOR hereby covenants with GRANTEE that GRANTOR has good titleto the above-
describedtractofland and covenants thatGRANTEE shallhave quietand peaceable possession
thereofand use thereofduringthe periodofthisTemporary ConstructionPermit.This Temporary
Permit isineffectfora periodbeginning the 1Stday of constructionon the property,and ending
two (2)years later,atwhich time thispermitshallexpireand be ofno forceand effect.
