RESOLUTION 2025 -66
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA,PROVIDING FOR THE ANNEXATION OF CERTAIN CONTIGUOUS TRACTS OF
LAND,HEREINAFTER DESCRIBED,TO THE CORPORATE LIMITS OF THE CITY OF BOZEMAN
AND THE EXTENSION OF THE BOUNDARIES OF THE CITY OF BOZEMAN SO AS TO
INCLUDE SAID CONTIGUOUS TRACTS,KNOWN AS 2221 SOUTH 3RD AVENUE
ANNEXATION,APPLICATION 24714.
WHEREAS,the Cityof Bozeman receiveda petitionforannexation from Museum of
the Rockies requestingthe CityCommission toextend the boundaries ofthe CityofBozeman
so as to includean area of land containingapproximately 1.048 acres,described herein;and
WHEREAS,an annexation staffreport was prepared in accordance with the
Commission's goals and policiesforannexation and was presented to the Commission on
July22,2005;and
WHEREAS,a publicmeeting on said annexation petitionwas duly noticedand held
on July22,2025;and
WHEREAS,the Cityreceivedno writtenprotestfrom realpropertyowners ofthe area
to be annexed;and
WHEREAS,on October 21,2025,the Commission receivedtheexecuted annexation
agreement addressing allrecommended terms ofannexation;and
WHEREAS,the provisionofavailableservices,including,but not limitedto,streets,
rights-of-way,easements,water rightsor cash-in-lieu,waivers of protestagainstcreationof
SID's,and water and sewer hookup fees,to saidcontiguous tractsas described isthe subject
ofa writtenagreement between the Cityand the Landowner;and
WHEREAS,the Bozeman CityCommission hereby findsthatthe annexation ofthis

contiguous tractisinthe best interestsof the Cityof Bozeman and the inhabitants/owners
thereof.
NOW,THEREFORE,BE IT RESOLVED by the City Commission of the City of
Bozeman,Montana,to wit:
Section 1
That itishereby declared that,pursuant to Title7,Chapter 2,Part46,Mont.Codes
Ann.,the following-describedproperty,which iscontiguous to the municipal boundaries of
the CityofBozeman,be annexed to the Cityof Bozeman and thatthe boundaries ofsaid City
shallbe extended so as to embrace and includesuch approximately 1.048 acres,towit:

Being CertificateofSurvey No.2636 Tract2 Located inthe Southeast One-Quarter
ofthe Southeast One-Quarter ofSection 13,Township 2 South,Range 5 East,
PrincipalMeridian Montana,GallatinCounty,Montana.
Commencing at a pointwhich isthe Southwest corner ofSection 13,Township 2
South,Range 5 East,P.M.M.,
Thence South 89°04'35"West,a distance of 30.01 feetalong the South lineof
Section 13 to the Pointof Beginning;thence South 89°04'35"West along the South
lineof Section 13 a distance of234.03 feet;thence South 89°05'57"West along the
South lineof said Section 13 a distance of26.63 feet;thence leavingsaid south
section lineNorth 0°54'03"West,a distance of 176.50 feet;thence South 89°48'51"
