Dear Mayor Cunningham and Members of the Bozeman City Commission, We are writing ahead of your final adoption of the Unified Development Code to urge you toretain the 70-foot height limit in the B-3 downtown zone, as you thoughtfully decided during your December 2 public hearing. At your December 2 meeting—after many hours of testimony and difficult deliberation—you struck an important balance. By keeping the base height at 70 feet while allowing additionalheight only through the Affordable Housing Ordinance, you preserved something critical: leverage for community benefit. If a developer wants more height, the community receivessomething meaningful in return—either deed-restricted affordable units or cash-in-lieu that directly supports housing goals. That is smart policy. It recognizes that height has value, andthat value belongs to the whole community, not just private interests. Respectfully: please stand by your earlier decision, do not give that leverage away. You gotthis right. We also want to acknowledge the enormous amount of work that has gone into this coderewrite.
