During the 9+ hours of the December 2nd UDC provisional adoption hearing, the City
Commission reversed the 90-foot B3 height limit back down to the existing standard of
70 feet. The Commission dialogue, which lasted approximately six minutes, was
prompted by two written public comments submitted within 36 hours of the public
hearing. Unfortunately, the discussion about downtown height limits took place with no
prior notice and was after public testimony was closed.
Since the initial release of the draft UDC in August 2023, the City Commission has
diligently held over 100 community engagement events and received over 1000 written
public comments. During the two and half-year period of intense public scrutiny and
multiple rounds of revisions, the 90-foot building height provision remained in the final
draft. Throughout, City staff and the Commission made certain that the decisions they
made were well thought out and intentional. Yet the last-minute downtown building
height decision provisionally reversed a six-year-old adopted recommendation of the
2019 Downtown Bozeman Improvement Plan. Unfortunately, no substantive
consideration was given to the planning context and future consequences. The long
envisioned and much publicized code revision for a modest increase in downtown
density, functionally allowing one additional floor, was seemingly dismissed in an
instant.
We, the undersigned, respectfully ask the City Commission to carefully review the
circumstances, consider the planning context, revert the B3 maximum building height to
90' as originally proposed, and adopt the UDC in this form on December 16, 2025.
