After discussion with Brian, I am not sure that a determination would be required, as the indeterminate end date would be acceptable to meet the standard of a long term lease. Please let me know if you have any questions or if there is a more updated lease that has different verbiage. I’m not sure if it is the latest version though. I’ve copied Cathy and Ben here, can you confirm that this is the latest? It is an indefinite term lease. I started looking into the feasibility of a determination about the offsite parking. With the history of this parcel, it sounds like a lease at one point was written up? Do you have a copy of the proposed lease that you could send my way? I think this could help in making a decision.
