COMMISSION RESOLUTION NO. 2702
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, CREATING SPECIAL IMPROVEMENT DIS-
TRICT NO. 654 FOR THE PURPOSE OF ACCOMPLISHING THE EN-
GINEERING DESIGN, CONSTRUCTION, INSTALLATION, IN-
SPECTION AND ENGINEERING CERTIFICATION OF ASPHALT
STREET PAVING, INTEGRAL CURB AND GUTTER AND STORM
DRAINAGE IMPROVEMENTS ON A PORTION OF LEA WAY AND
ALL OTHER NECESSARY APPURTENANCES TO LOCAL STAN-
DARDS LESS SIDEWALKS.
WHEREAS, at a regular session of the City Commission of the City of
Bozeman, Montana, held on the 11th day of Apri I 1988, the said City Commis-
sion duly passed Commission Resolution No. 2692, declaring it to be the inten-
tion of said City Commission to create a Special Improvement District to be
known and designated as Special Improvement District No. 654 for the purpose
of accomplishing the engineering design, construction, installation, inspection
and engineering certification of asphalt street paving, integral curb and gutter
and storm drainage improvements. That said Commission Resolution No. 2692 is
hereby referred to and made a part hereof for further particulars in respect to
the boundaries of said Special Improvement District No. 654, the estimated cost
of said improvements and the method of assessing the same against the property
of the district; and
WHEREAS, the notice of the passage of Commission Resolution No. 2692
was duly published, as required by law, in the Bozeman Daily Chronicle, a daily
newspaper of general circulation printed and published in the City of Bozeman,
Montana, and by sending a copy of such notice by U. S. Mai I to each person,
firm or corporation having property within the proposed district at his or its
last known address, upon the same date that such notice as first published as
aforesaid, and due proof having been made of the publication and service of
said notice; and
WHEREAS, within the time provided by law and said published and
served notice, there was not sufficient protest against the creation of said
proposed Special Improvement District No. 654. The City Commission was in
regular session on the 2nd day of May 1988, at 7:00 o'clock p.m., at the Com-
mission Chamber in the City Hall Building in the said City of Bozeman,
Montana. The same was the time and place designated in said notice for pass-
ing upon all protests, if any, against the proposed work or against the creation
of said district. And, it further appears that all of the proceedings for the
creation of said district have been lawful and regular.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOZEMAN, MONTANA:
Section 1
That the said Special Improvement District No. 654 of the City of
Bozeman be and the same is hereby created for the purpose of making improve-
ments as set out in said Commission Resolution No. 2692 and hereinafter de-
scribed.
Section 2
That said special improvements be and the same are hereby ordered to
be made in Special Improvement District No. 654 as follows:
ENGINEERI NG DESIGN, CONSTRUCTION, INSTALLATION, IN-
SPECTION AND ENGINEERING CERTIFICATION OF ASPHALT
STREET PAVING, INTEGRAL CURB AND GUTTER AND STORM
DRAINAGE IMPROVEMENTS ON A PORTION OF LEA WAY AND
ALL OTHER NECESSARY APPURTENANCES TO LOCAL STAN-
DARDS LESS SIDEWALKS.
Section 3
That the entire cost and expense of the improvements herein referred to
in said Special Improvement District No. 654 shall be assessed against the entire
district. Each lot, block, tract or parcel of land within the district boundary

will be assessed for that portion of the whole cost which its area bears to the

area of the entire district, exclusive of streets, avenues and alleys.
The total actual assessable area within the entire district is 119,430
square feet and is the area on which all assessments will be calculated. It is
also the square footage on which all assessments will be figured.
PASSED AND ADOPTED by the City Commission of the City of Bozeman,
Montana, at a regular session thereof held on the 5th day of July 1988.
